A RESOLUTION OF THE CITY CO~CIL OF THE CITY OF ARCADIA, ORDERING CERTAIN" WORK AIm IMPROVE1,ffiNT TO BE DONE ON PORTIONS OF LAS TUNAS DRIVE AND OTHER STREETS, IN SAID CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require that certain work and improvement be done in the City of Arcadia, to wit: That a concrete gutter be constructed along the northerly side of the roadway of Las Tunas Drive, from sixty-seven (671) feet west of thewest line of Holly Avenue, to El Monte and also along the southerly side of the roadway of Las Tunas Drive, from the westerly line of Tract No. 12277, as per map recorded in Book 233, page 7 of Maps, Records of the County Reco~der of Los Angeles County, to El Monte Avenue, except where such concrete gutter is now in place to the official line and grade, and is in good condition, and the City Council of the City of Arcadia hereby orders the same to be done, in accordance with Specifications and Improve- ment Plan No. C-183, on file in the office of the City Engineer of s@.id City of Arcadia, adopted for s aid work, and under the direction and to the satisfaction of Street Superintendent of said City of Arcadia; that Resolution of Intention No. 1932, heretofore adopted by the City Council on the 18t~ day of October, 1949, contains a complete description of the work and improvement to be done pursuant to this Reaolution, and refer- snce is hereby made to s aid Resolution of Intention No. 1932 for a complete description of the said work and improvement, and of the streets, or portions of streets in which said work and improvement shall be done. \ 1. t1"40EXEO SECTION 2. That the grade to which the work herein- above described shall be done and the improvement made as pro- vided in this Resolution is shown on Profile and Improvement Plan No. C-183, on file in the office of the City Engineer of the City, to which Profile I' eference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accordance with s aid Profile and Improvement Plan No. C-183, on file in the office of the City Engineer of said City of Arcadia, All work on grading and the construction of concrete gutters shall be in accordance with the following specifications on file in the office of the City Engineer of said City of Arcadia, to wit: "Standard Specifications No. 0, for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." Said Profile and Improvement Plan No. C-183 and the specifications hereinabove referred to were adopted by Resolu- tion No. 1910 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution- and are hereby referred to for a more particular description of said work. All streets and avenues referred to in this Resolution are public streets and avenues of said City. SECTION 4. That said contemplated work and improvement, in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which District said City Council hereby declares to be the District benefited by said work and 2. improvement and to be assessed to pay the costs and expenses thereof, which said District shall include all those lots, or parcels of land, and all of the land in the said City of Arcadia fronting on and adjacent to the streets or portions of such streets described in said Resolution of Intention No. 1932. A plat or map of said District indicating by a boundary line the extent of the lands included in said District was approved and adopted by Resolution No.1931 of the City of Arcadia on the 18th day of October, 1949, and is on file in the office of the City Engineer of the City of Arcadia; re- ference is hereby made to said plat or map for a further, full, and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-55, and said map so on file shall govern for all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and de- clares that Serial Bonds shall be issued to represent each assessment of Twenty-five Dollars ($25.00) or more, remaining unpaid for thirty (30) days after the date of the Warrent to represent the expenses of said work and improvements. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th, following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th, after their date, until the vmole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July, respectively of each year after their date at the rate of six per cent (6%) per annum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of 3. the City Treasurer of the City of Arcadia. SECTION 6. All proceedings for the aforesaid work and improvement and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designated as the "Improvement Act of 1911", being Division 7, Streets and Highways Code of the State of California. SECTION 7. The Arcadia Bulletin, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice of said work and improvement, inviting sealed proposa~ , shall be puglished in the manner and form and by the persons required by law. SECTION 8. The City Clerk of the City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together w1th the Specifications therefor, inviting sealed proposals or bids for doing said work and said City Clerk is also directed to publish twice in said newspaper designated as aforesaid, in the manner and form required by law, a notice inviting sealed proposals or bids for doing said work, and referrang to the Specifica- tions posted or on file. Said notice shall require a certified check, or bond, either, as prescribed Thy law for an amount not less than ten percent of the aggregate of the proposal. Said sealed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on or before eight o'clock p.m. on December 6, 1949; bids will be opened on said day and hour . SECTION 9. The City Clerk shall certify to the adoption of this Resolution. 4. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of .4rcadia, held on the 15th day of November, 1949, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen, Boucher, Klomp, Nugent and Russell NOES: None ABSENT: Councilman Libby /P City Clerk of the City f Arcadia.
