A RESOLUTION OF THE CITY CO~CIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING I~S IN1EN1ION 10 n~PROVE A PORTION OF Ttffi FIRST ALLEY NORTH OF Hu}flING~ON DRIVE IN SAID CITY OF ARCADIA, AND DECLARING SAID WORK OR IMPROVE~N'l' 10 BE OF MORE ~HAN LOCAL OR ORDINARY ~UBLIC BENEFI~ AND DES- CRIBING ~HE DISTRICT TO BE BENEFITED BY SAID WORK OR IMPROVElvffiN'l' AND TO BE ASSESSED '1'0 ~AY 'fHE COSTS AND EXPENSES THEREOF, AND DETERMINING 1'HAT SERIAL BONDS SHALL BE ISSUED TO RE~RESENT SAID COSTS AND EXPENSES AND FIXING A TIME FOR HEARING OBJECTIONS '1'0 SAID WORK OR IMPROVE~ffiN'1', OR '1'0 THE EXTEN'f OF THE DISTRICT TO BE ASSESSED, OR BOTH. THE CITY CO~CIL OF 1HE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. 'I'hat the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia to order the following work and improvement to be done in said City of Arcadia, to wit: FIRST: That a cement concrete gutter three (31) feet in width, be constructed along a line fourteen feet (14') south- erly from and parallel with the northerly line of the First Alley north of Huntington Drive, from the easterly line of First Avenue to the westerly line of Indiana Street, except where such concrete gutter is now in place to the official line and grade, and is in good condition. SECOND: That the portion of the said alley between a line one (11) foot southerly from and parallel with the northerly line of said alley and the northerly gutter line thereof, from "he easterl;y' line of First Avenue t;Q the westerly line of Indiana Street be graded and paved with asphaltic concrete pre-mix pave- ment two and one quarter (2t") inches in thickness, and also that portion of the said alley between a line one (l') foot northerly from and parallel with the southerly line of said alley and the southerly gutter line thereof, from "he easterly line 1. ,<~o ,>10"" of First Avenue and the westerly line of Indiana Street be graded and paved wi~h asphaltic concrete pre-mix pavemen~ two and one- quarter (2i") inches in thickness, except where such asphaltic concrete pre-mix pavement, or oil macadam pavement is now in place ~o the official line and grade, and is in good condition. THIRD: ~hat a cement concrete apron six inches (6") in ~hickness be constructed in the intersection of First Avenue with ~he westerly termination of ~he first Alley north of Hun~ington Drive, from a line ~en (10') feet westerly from and parallel wi~h ~he easterly line of First Avenue, except where such cemen~ con- cre~e apron is now in place ~o the official line and grade, and is in good condition. SECTION 2. The grade to which the work shall be done and improvement made which is provided for in this Resolution of Inten~ion shall be tha~ shown on the Profile and Improvement ~lan No. C-184 on file in the office of the City Engineer of said City, and reference is hereby made to said plans and profiles for a description of such grade. SECTION ~. That all of the foregoing work and improve- ment shall be done in accordance with said Profile and Improvemen~ Plan No. C-184, on file in the office of the City Engineer of the City of Arcadia. That all of the foregoing work on grading and the cons- ~ruction of cement concrete gutters, cement concrete pavement shall be in accordance with the following specifications on file in ~he office of the City Engineer of the City of Arcadia, to wit: "Standard Specifications No. 0 and No. 1 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." That all of the foregoing work on the construction of street pavement shall be in accordance with the following Speci- fications on file in the office of the Ci~y Engineer of ~he City of Arcadia, ~o wit: "Specifications for asphaltic concrete pre- 2. mix pavement and wearing surface". Said profile and improvement plan No. C-184 and the speci- fications hereinabove referred ~o were adopted by Resolution No. 1947 of said City Council of the Ci~y of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred ~o for a more particular description of said work. All alleys, streets and avenues referred to in this Resolution are public alleys, streets and avenues of said City. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said Ci~y Council hereby makes the expense of said work and improvement chargeable upon the District, which District said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof. A plat or map of said District, indicating by a boundary line the extent of the lands included in the proposed Assessmen~ District, was approved and adopted by Resolution No. 1948 of the City Council of said City of Arcadia, and is on file in the office of the Ci~y Engineer of the City of Arcadia. Reference is hereby made to the said pla~ or map for further, full and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-57, and said map so on file shall govern for all details as to the exten~ of such Assessment District. SECTION 5. Said City Council also determines and declares ~hat Serial Bonds shall be issued to repreaent each assessmen~ of ~wenty-five ($25.00) Dollars, or more, remaining unpaid for thirty (30) days after the date of the warrant to represent the expenses of said work and improvement. Said serial bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15~h following their ;:,. date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after their d ate, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July, respectively, of each year after their date, at the r ate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby given that on Tuesday, the 6th day of December, 1949, at the hour of 8:00 o'clock p.m. on said day, in the Council Chamber of the City Hall in said City of Arcadia, any and all persons having objections to said proposed work or improvement or to the extent of the district to be assessed, or both, may appear before said City Council and show cause why said ,proposed work or improvement should not be carried out in accordance with this Resolution. SECTION 7. All proceedings for the aforesaid work and improvement and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and' designated as the "Improvement Act of 1911", being Division 7 of Streets and Highways Code of the state of California. SECTION 8. Notice is hereby given that in accordance with the provisions of Section 2804 of the Streets and Highways Code of the State of California, as amended, the written waiver of the owners of more than 60% in area of the property subject to assess-' ment for said proposed improvement described herein having been signed and filed with the City Clerk of the City of Arcadia, the investigation and report of the City Engineer provided for in the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, being Division 4 of the streets and Highways Code of the State of California, are hereby specifically waived. 4. SECTION 9. The Superintendent of Streets shall post or cause to be posted conspicuously along the line of said contem- plated work or improvement and also along all the open streets within the district liable to be assessed and hereinabove described, notices of the passage of this Resolution in the manner and form required by law. SECTION 10. The Ci~y Clerk shall certify to the adoption of ~his Resolution and shall cause the same to be published twice in ~he Arcadia Bulletin a newspaper of general circulation, pub- lished and circulated in the City of Arcadia and hereby designa~ed for that purpose; ~he City Clerk shall also mail notice of the adoption of this Resolution to all persons owning real property proposed to be assessed, whose names and addresses appear on the last'equalized assessment roll for City taxes, ~ as kno?m to saif Clerk. Such notice shall be given in the manner and form required by said "Improvement Act of 1911", being Division 7, Streets and Highways Code of the State of California.
