A RESOLUTION OF THE CITY CO~CIL OF THE CITY OF ARCADIA, APPROVING AND ADOPTING THE RECOM- MENDATION OF THE PLANNING COMMISSION OF SAID CITY ~O DENY THE ~ETITION FOR A VARIANCE AF- FEC~ING CERTAIN REAL ~ROPERTY LOCA~ED ALONG ~HE EAST SIDE OF THIRD AVENUE, IN SAID CITY. ~HE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: WHEREAS, on the 14th day of September, 1949, there was filed wioh the Planning Commission of the City of Arcadia the petition of Joseph T. Scalzo and Olive R. Scalzo, requesting a zoning variance on the following described pro- perty, in the City of Arcadia, to wit: Lot 18, Tract 6860, as shown on map recorded in Book 78, page 75 of Maps, Office of the County Recorder of Los Angeles County, to permit the maintenance and operation of an automobile upholstering and seat cover shop, and WHEREAS, said property is now located in a residential zone, to wit R-0 zone, and VrrrnREAS, after notice, as required by the provisions of Ordinance No. 760, a public hearing on ohe matter was held before the Planning Conwission of the City of Arcadia, on the 6th day of October, 1949, and all inoerested parties were given a full opportunity to be heard, and WHEREAS, in the opinion of the ~lanning Co~aission the maintenance of the contemplated business uses set forth in said petition in a residential zone would be detrimental to the public welfare and in~urious to the surrounding property, and would adversely affect the comprehensive general plan of the city, 1. ..-1(".0 ,~o""'~'" WHEREAS, the Planning Commission of the City of Arcadia recommended in its Resolution No. 12, dated the 3rd of Novem- ber, 1949, that the aforesaid petition be denied, for the following reasons, to wit: 1. A majority of property owners within a 300-foot radius of the property in question object to any variance that will permit a business operation in a residential zone, R-3 Multiple Family Zone; 2. The request of petitioner is contrary to the spirit and intent of the Master Zoning Plan of the City of Arcadia which was adopted and became effective on June 3rd, 1949, after a series of public hearings and which plan was unanimous- ly approved by the Planning Commission gnd the City Council; 3. The action requested by the petitioner is, in the opinion of the Commission, con~rary to good planning practice as it involves business or commercial use of this property withou~ due regard for the property rights of others located in the same block; AND, \VHEREAS, the aforesaid Resolution No. 12 of the Planning Commission of the City of Arcadia was adopted by ~he Commission on the 3rd day of November, 1949, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recommendations of the Planning Commission, as set forth in said Resolution No. 12, or said Commission, and does hereby geny ~he request of petitioners for a zoning variance affecting the real property hereinabove described. SECTION 2. The City Clerk shall certify ~o the adoption of ~his Resolution. 2. WHEREAS, the Planning Commission of the City of Arcadia recommended in its Resolution No. 12, dated the 3rd of Novem- ber, 1949, that the aforesaid petition be denied, for the following reasons, to wit: 1. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recommendations of the Planning Commission, as set forth in said Resolution No. 12, of said Commission, and does hereby ~eny the request of petitioners for a zoning variance affecting the real property hereinabove described. SECTION 2. The City Clerk shall certify ~o the adoption of this Resolution. 2.
