A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION '1'0 IMPROVE A PORTION OF DIAMOND STREET IN SAID CITY OF ~~CADIA, AND DECLARING SAID WORK OR IMPROVE- bffiNT 1'0 BE OF MORE THAN LOCAL OR ORDINARY ~UBLIC BENEFIT AND DESCRIBING '1'HE DISTRICT TO BE BENE- FITTED BY SAID WORK OR IMPROVEMENT AND TO BE ASSESSED 'ro YAY ~'HE COSTS PJ1D EXYENSES THEREOF, AND DETERMINING THAT S&~IAL BONDS SHALL BE ISSUED TO REPRESEN'1' SAID COSTS AND EXPENSES AND FIXING A 1'Ibffi FOR HEARING OBJECTIONS TO SAID WORK OR IMPROVEI:illNT, OR TO THE EXTEN'l' OF THE DISTRICT TO BE ASSESSED, OR BOTH. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the public in~erest and convenience require and it is the intention of the City Council of the City of Arcadia to order the following work and improvement to be done in said Ci~y of Arcadia, ~o wit: FIRST: That a concrete sidewalk be constructed along the southerly side of Diamond Street from Santa Anita Avenue to First Avenue, and also that concrete sidewalk be constructed in the return at the southeast corner of Santa Anita Avenue and Diamond Street, except where such concrete sidewalk is now in place to the official line and grade and is in good condition, all as shown on the plans hereinafter referred to. SECTION 2. That the grade to whiCh the work hereinbe- fore described snaIl be done and the improvement made as pro- vided in this Resolution is shown on Profile and Improvement Plan No. 185, on file in the office of the City Engineer of said City, to Which Profile reference is hereby made for the aes- cription of such grade. SECTION 0. All of the foregoing work shall be done in accordance with said Profile and Improvement plan No. C-185, on file in the office of the City Engineer of said City of Arcadia. 1. All work on grading and the construction of concrete sidewalk shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, to wit: "Standard Specifications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement". Said Profile and Improvement Plan No. C-185 and the specifications hereinabove referred to were adopted by Resolu- tion No. 1955 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. The Streets and Avenues referred to in this Resolution are public streets and avenues of the City of Arcadia. SECTION 4. That said contemplated work and improve- ment in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which District said City Council hereby declares to be the district benefitted by said work and improvement and to be assessed to pay the costs and expenses thereof. A plat or map of said District, indicating by a boundary line the extent of the lands included in the proposed Assessment District, was approved and adopted by Resolution No. 1956 of the City Council of said City of Arcadia, and is on file in the of- fice of the City Engineer of the City of Arcadia. Reference is hereby made to the said plat or map for further, full and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-56, and said map so on file shall govern for all details as to the extent of such Assess- ment District. SECTION 5. Said City Council also determines and de- clares that Serial Bonds shall be issued to represent each assess- 2. ment of twenty-five ($25.00) dollars, or more, remaining unpaid for thirty (60) days after the date of the warrant to represent the expenses of said work, and improvement. Said Serial Bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15th following their d~te and an even annual proportion of the principal sum thereof ahall be payable by coupon on the second day of January of each year, following the next October 15th after their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July, respectively, of each year after their date, at the rate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon shall be pay- able at the office of the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby given that on Tuesday, the third day of January, 1950, at the hour of 8:00 P.M. on said day, in the Council Chamber of the City Hall in said City of Arcadia, any and all persons having objections to said proposed work or improvement, or to the extent of the District to be assessed, or both, may appear before said City Council and show cause why said proposed work or improvement should not be carried out in accord- ance with this Resolution. SECTION 7. All proceedings for the aforesaid work and improvement, and for the issuance of said bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the state of California, known and designated as the "Improvement Act of 1911", being Division 7 of streets and Highways Code of the State of California. SECTION 8. The report of the City Engineer, as required to be made by the provisions of the Special Assessment, Investi- 3. gation, Limitation and Majority Protest Act of 1931, being Divi- sion 4, streets and Highways Code aforesaid, and the report on the hearing required to be held as provided in said Act, are on file in the office of the City Clerk of the City of Arcadia, and are open to public inspection, and may be examined at his office, in the City Hall of the City of Arcadia. SECTION 9. The Superintendent of Streets shall post or cause to be posted conspiculously along the line of said con- templated work or improvement and also along all the open streets within the district liable to be assessed and hereinabove described, noticesof the passage of this Resolution in the manner and form required by law. SECTION 10. The City Clerk shall certify to the adop- tion of this Resolution and shall cause the same to be published twice in the Arcadia Bulletin, a newspaper of general circulation, published and circulated in the City of Arcadia and hereby des- ignated for that purpose; the City Clerk shall also mail notice of the adoption of this Resolution to all persons owning real property proposed to be assessed, whose names and addresses ap- pear on the last equalized assessment roll for City taxes, or as known to said Clerk. Such notice shall be given in the manner and form required by said "Improvement Act of 1911, being Division 7, Streets and Highways Code of the state of California."
