RESOLUTION DIRECTING AMENDMENT, ALTERATION,
MODIFICATION, AND CORRECTION OF THE ASSESS-
MENT AND DIAGRAM FILED IN THE SEWER PROCEED-
ING UNDER AND PURSUANT TO RESOLUTION OF
INTENTION, RESOLUTION NO. 1725, OF THE CITY
OF ARCADIA, CALIFORNIA.
WHEREAS, in a proceeding for the construction of
certain sanitary sewer work or improvement, the City Council
of the City of Arcadia adopted its Resolution of Intention,
Resolution No. 1725, on the 10th day of November, 1947; and
WHEREAS, the Superintendent of Streets of the City
of Arcadia did, on the 12th day of September, 1949, duly file
in the office of the City Clerk of the City of Arcadia an
assessment for the costs and expenses of said work and improve-
ment described in said Resolution of Intention and a diagram
of the property affected or benefited by said work as described
in said Resolution of Intention; and
~~REAS, said City Clerk, as required by law, gave
notice of the filing of said assessment and of the time, to wit,
October 4, 1949, at 7:)0 o'clock, P.M., fixed in said notice
for a hearing by this City Council, and said notice was duly
published, posted and mailed, and affidavits of publication,
posting and mailing of such notice have been approved by this
City Council and are on file in the office of the City Clerk;
and
WHEREAS, prior to the day fixed for the hearing upon
the assessment certain written appeals or protests were filed;
and
WHEREAS, on the day fixed for the hearing and
subsequent thereto certain additional protests or appeals
were riled; and
WHEREAS, at the time and place fixed for the hearing
in the Council Chambers in the City Hall, the number of per-
sons present and desiring to hear and be heard was too large
to be accommodated in said Council Chambers and filled large
portions of the halls of the City Hall and part of the grounds
adjacent thereto, and said hearing was duly and regularly con-
tinued and adjourned; and
WHEREAS, subsequent to said October 4, 1949, the
City Council has duly and regularly adjourned and continued
said hearing from time to time and a portion of said hearing
has been held in the Paddock Room at the Santa Anita Race
Track in the City of Arcadia when the Council Chambers were
inadequate to accommodate the persons who desired to hear
and be heard; and
WHEREAS, the remainder of said hearing has been
held in the Council Chambers in the City Hall of the City of
Arcadia, and each and every portion of the hearing in said
Paddock Room and in the Council Chambers in the City Hall has
been duly held pursuant to an order of continuance and adjourn-
ment duly adopted; and
WHEREAS, the City Council of the City of Arcadia
has given all persons who riled written protests or appeals
prior to October 4, 1949, an opportunity to be heard both in
the Paddock Room and in the Council Chambers in the City Hall,
and has likewise given to any and all persons who filed pro-
tests or appeals on October 4, 1949, or subsequently, an

opportunity to be heard and has given all persons desiring
to be heard an opportunity to protest orally, and evidence
has been taken by the City Council upon the matters pre-
sented by said appeals or protests or presented at said
hearing, and all of said appeals or protests filed prior
to October 4, 1949, have been read to this City Council at
said hearing and have been duly considered, and all protests
or appeals filed late, to wit, on October 4, 1949, or sub-
sequently, have likewise been read to the City Council at
said hearing and have been duly considered, and all oral
protests or appeals have been heard and duly considered,
and full and ample opportunity to be heard has been given
all persons; and
WHEREAS, this City Council has examined and con-
sidered said diagram and assessment and the form of warrant
attached thereto, and has considered the proceedings prior
thereto, and has considered the evidence presented at said
hearing, and finds that it is desirable to alter, amend,
modify or correct the assessment and diagram in certain
particulars as are hereinafter set forth and in such manner
as to the Council seems just;
NOW, THEREFORE, the City Council of the City of
Arcadia, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER
as follows:
Section 1. That the Superintendent of Streets of
said city be and he is hereby instructed to amend, alter,
modify or correct said assessment in accordance with this
resolution and as particularly set forth in the "Schedule of
Modifications" incorporated herein and made a part hereof,
and to amend, alter, modify or correct said diagram in

accordance with the changes in the assessment, and to return
said assessment and diagram, as so amended, altered, modified
or corrected, to this City Council as soon as said amendments,
alterations, modifications or corrections are made. Said
"Schedule of Modifications" is as follows, to wit:
