A RESOLUTION OF THE CITY COUNCIL OF TIIE CITY OF ARCADIA, CALIFORNIA, APPROVING A~~ ADOPTING Tfffi RECOMI,iENDATION OF THE pLANNING COMMISSION OF SAID CITY TO DENY THE pETITION FOR A VARIANCE AFFECTING CERTAIN REAL pROPERTY LOCATED ON THE EAST SIDE OF HOLLY AVENUE SOUTH OF v'iALIIWT AVEIIWE, IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: VVHEREAS, on the 6th of October, 1949, there was filed with the Planning Commission of the City of Arcadia the peti- tion of Norman O. Lund and J. Errett Wilkinson, requesting a zoning variance on the following described property, in the City of Arcadia, to wit: The Southerly 100 ft. of Lots 22 and 23, Tract No. 13630, as shown on Map recorded in Book 238, pages 42-43 of Maps, records of Los Angeles County, to permit erection and use of a single family dwelling, and WHEREAS, the property is now located in a first, one- family residential zone, to wit, R-O zone, and WHEREAS, after notice as required by the provisions of Ordinance No. 760, a public hearing on. the matter was held before the Planning Commission of the City of Arcadia, on the 3rd day of November, 1949, and all interested parties were given a full opportunity to be heard, and ~mEREAS, in the opinion of the Planning Commission the zoning variance that would permit the dividing of a lot or lots in an R-O zone, and the building of another structure thereon would be detrimental to the public welfare and injurious to surrounding property, and would adversely affect the com- prehensive general plan of this City, 1. \IlOEl'''O AIID, VffiEREAS, the Planning Commission of the City of Arcadia, in its Resolution No. 15, dated December 1, 1949, recommended that the aforesaid petition be denied, for the following reasons, to wit: 1. The request of petitioners is contrary to the spirit and intent of the Master Zoning Plan of the City of Arcadia which was adopted and became effective on June 3rd, 1949, after a series of public hearings and which plan was unanimously approved by the Planning Commission and the City Council; 2. A majority of property owners within a 300 foot radius of the property in question, and other property owners in the neighborhood, object to any variance that would per- mit the division of R-O zone lots and/or the erecting of buildings thereon; 3. The granting of this variance an~ the improving of the lot so formed would effectually prevent any future street that may be desired from Holly to El Monte between Walnut and Palm. Vifhile it may grant relief to two property owners in this block, it would at the same time prevent any future relief to twenty other property owners in the same block and would therefore be detrimental to their interest; 4. The Planning Commission considers it inconsistent with good planning practice to encourage or permit changing the boundaries of recorded lots to circumvent the intent of the Master Zoning Ordinance; ArID, ~lliEREAS, the aforesaid Resolution No. 15 of the Planning Commission of the City of Arcadia was adopted by the Commission on the 1st day of December, 1949, 2. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recom- mendations of the Planning Corr~ission, as set forth in said Resolution No. 15, of said Co~mission, and does hereby deny the request of petitioners for a zoning variance affecting the real property hereinabove described. SECTION 2. The City Clerk shall certify to the adop- tion of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 20th day of December, 1949, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Boucher, Klomp, Libby and Nugent NOES: None ABSENT: Councilman Russell City Clerk of the SIG~~D A~ID APPROVED THIS 20th day of December, 1949.
