A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING AND ADOPT- ING THE R ECOMJv!ENDATION OF THE PLANNING COM- MISSION OF SAID CITY TO GRA1IT A PETITION FOR THE RE-ZONING OF CERTAIN REAL PROPERTY LOCATED NEAR BALDWIN A VENUE AND DUARTE ROAD, IN SAID CITY AND HEREINAFTER DESCRIBED. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: VffiEREAS, on the 15th day of September, 1949, there was filed with the Planning Commission of the City of Arcadia the petition of Glenn M. Dysart, requesting a change of zone classi- fication of the following described real property in the City of Arcadia, to wit: The south 100 feet of the north 250 feet of the west one-half of lot 6, Tract No. 4090, as shown on map recorded in Book 43, Page 47, of Maps, records of Los Angeles County, to permit the construction of a public alley and an automobile parking lot, and WHEREAS, the property is now located in an R-2 Zone (two-family zone), and VftlEREAS, after notice as required by the provisions of Ordinance No. 760, a public hearing on the matter was held before the Planning Commission of the City of Arcadia, on the 17th day of November, 1949, and all interested parties were given a full opportunity to be heard, and ~~REAS, in the opinion of the Planning Commission, such change from Zone R-2 to Zone C-2 of the herein described property, except the north 250 feet thereof, and the change of the north 250 feet aforesaid from Zone R-2 to Zone PR-2, would not be detrimental to the public welfare nor injurious to sur- rounding property, and would not adversely affect the compre- hensive general plan of the City, 1. INO<~"O P.JID, WHEREAS, the Planning Commission of the City of Arcadia, in its Resolution No. 17, dated December 15, 1949, recommended that the aforesaid petition be approved, for the follovdng reasons, to wit: 1. Petitioner has undertaken and agreed to dedicate to the City of Arcadia the southerly twenty (20) feet of said west one-half of Lot 6 aforementioned for use as a public alley, and that the property hereinbefore described shall not be re- lieved from the levy of a special assessment under any special / assessment statute of the State of California for the improvement of such alley. AND, WHEREAS the aforesaid Resolution No. 17 of the Planning Commission of the City of Arcadia was adopted by the Commission on the 15th day of December, 1949, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recommendations of the Planning Commission, as set forth in said Resolution No. ~7 of said Commission, and does hereby approve and adopt the request of petitioner for a zoning variance affecting the real property he~einabove described. SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
