A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE RECOMwlliNDA- TION OF THE PLArTIjING COMMISSION OF SAID CITY TO GRAt~ A PETITION FOR A VARIANCE AFFECTING CER- TAIN REAL PROPERTY LOCATED AT 330 HUNTINGTON PLACE, IN SAID CITY, AIID HEREINAFTER DESCRIBED. Trill CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: WhEREAS, on the 2nd day of November, 1949, there was filed with the Planning Commission of the City of Arcadia the petition of the Roman Catholic Archbishop of Los Angeles, the owner of the real property located within the City of Arcadia, California, hereinafter described, to wit: The westerly ninety (90) feet of Lot 43, Tract No. 11969, as shown on map recorded in Book 259, pages 36 and 37 of Maps, records in the office of the County Recorder of Los Angeles County, and that portion of Lot 4, Tract No. 2409, adjoining on the north, being located at 330 Huntington Place, in said City of Arcadia, to permit the conduct of a Catholic convent, together with necessary fences, walls, g~ages, driveways and entrances, and VmEREAS, said property is now located in a residential zone, to wit, R-l Zone, and WHEREAS, after notice as required by Ordinance No. 760, a public hearing on this matter was held by and before the Planning Commission of the City of Arcadia, on the first day of December, 1949, and all interested persons were given a full opportunity to be heard, and ~~EREAS, in the opinion of the Planning Comnission the maintenance of a Catholic convent with necessary appurtenances would not be detrimental to the public welfare nor injurious to 1. IND~)t'C.O to surrounding property, nor adversely affect the comprehensive general plan of the City of Arcadia, and WnEREAS, the Planning Commission of the City of Arcadia recommended in its Resoll1tion No. 16, dated the 15th of Decem- ber, 1949, that the aforesaid petition be approved and granted, subject to the following terms and conditions: 1. That the aforementioned property may be used only for the conduct of a Catholic convent, together with necessary fences, walls, garages, driveways and entrances; 2. That in case anyone or more of the provisions or conditions of the aforesaid Resolution No. 16 be violated, the property herein described shall revert to Zone R-l, as defined in Ordinance No. 760, and all of the rights and privileges herein granted shall cease and terminate, in the event that any such violation is not terminated within thirty days, or such further time as the City Council may decide that the owners of said property, in the exercise of due diligence, require to correct such yiolation, after the owners of said property have been given v~itten notice by the City Council of said violation or viol~tions. A~~, WnEREAS, the aforesaid Resolution No. 16 of the Planning Commission of the City of Arc.adia was adopted by the Commission on December 15, 1949, NOW, THEREFORE BE IT RESOLVED: SECTION 1. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recommendations of the Planning COffiW.ission, as set forth in said Resolution No. 16 of s~id Commission, and does hereby grant to petitioner a conditional zoning variance affecting the real property herein- 2. before described, subject to the terms and conditions in said Resolution expressly enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
