RESOLUTION NO. 1977.
A RESOLL~ION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING AND ADOPTING THE
RECO~ilJENDATIONS OF THE PLANNING COM~ISSION OF
SAID CITY TO DE~N A PETITION FOR THE RE-ZONING OF
CERTAIN REAL PROPERTY, LOCATED AT 322 HUNTINGTON
PLACE, IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE
AS FOLLOVIS:
Wh~~EAS, on the 4th day of November, 1949, there was
filed with the Planning COIl'.mission of the City of Arcadia the
petition of Martin J. Stately and Frances E. Stately, requesting
the re-zoning of the following described real property in the
City of Arcadia, to wit:
That portion of lot 43, tract No. 11969, as shown on
map recorded in Book 259, pages 36 and 37 of Maps,
records of Los Angeles County, and that Rortion of lot
4, tract No. 2409, as shown on map recorded in book 23,
page 23 of Maps, lying between the northerly prolonga-
tion of the easterly and westerly lines of lot 38 of
said tract No. 11969, being located at 322 Huntington
Place, in said City of Arcadia
to permit the above described property to be used for the purpose
of multiple dwelling; and
iTI1EREAS, said property is now located in a residential
zone, to wit R-l zone, and
Vfu~REAS, after notice as required by Ordinanc~ No. 760
a public hearing on this matter was held by and before the Plann-
ing Commission of the City of Arcgdia, on the first day of Decem-
ber, 1949, and all interested persons were given a full opportunity
to be heard; and

\~{EREAS, in the opinion of the Planning Conwission, the
proposed ra-zoning of the aforesaid property would be detrimental
to the public welfare and injurious to surrounding property, and
would adversely affect the Comprehensive General Plan of the City;
and
WnEREAS, the Planning Commission of the City of Arcadia
recon~ended in its Resolution No. 19, dated the 5th day of
January, 1950, that the aforesaid petition be denied, for the
folloving reasons:
1. The request of the petitioners is contrary to the
spirit and intent of the Master Zoning Plan of the City of Arcadia
which was adopted and became effective on June 3, 1949, after a
series of public hearings and which plan ~as unanimously approved
by tre Planning Co~~ission of the City of Arcadia; that at the
time of said public hearings, due consideration was given by
the Commission to the extension of multiple dwelling zoning in
an Easterly direction upon and along Huntington Place from
Holly Avenue;
2. It is the opinion of the Planning Co~~ission that
there have been no changes in circlwstances relating to the
petitionersl property, since the same matter was reviewed during
the public hearings prior to the adoption of the !.laster Zoning
Plan, which warrant or justify the re-zoning of subject property
at this time;

3. This proposed re-zoning would be in direct conflict
with the restrictions in the deeds to this and surrounding
properties and would be contrary to the expressed wishes of
practically all of the property owners in the general vicinity
of petitioners I property, such property owners being desirous of
maintaining the present single-family zoning of the area involved.

4. Under the terms of Ordinance Ro. 760, covering the
planning procedure of the City of Arcadia, land use should be
re-zoned by the Planning Commission and the City Council only
in the event that such re-zoning is required by ftpublic necessity
and convenience and general welfare". In the opinion of the
Corr~ission public necessity and convenience and general welfare
do not require or indicate the desirability of the re-zoning
requested by the petitioners.
AND, ~~lliREAS, the aforesaid Resolution No. 19 of the
Planning COI~Bission of the City of Arcadia was adopted by the
Commission on January fifth, 1950,
NOW, T}lliREFORE BE IT RESOLVED:
SECTION 1. That the City Council of the City of Arcadia
does hereby approve and adopt the foregoing recommendations of
the Planning Commission, as set forth in said Resolution No. 19
of said Commission, and does hereby deny to petitioners the re-
quest for re-zoning heretofore described.
SECTION 2. The Cit~r Clerk shall certify to the adoption
of this Resolution.
I H~REBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 17th day of January, 1950, by the affirmative vote
of at least three Councilmen, to wit:
