A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING AND ADOPT- ING THE RECOMMENDATIONS OF 'l'HE PLANNING COM- MISSION OF SAID CITY, TO DE~IT A PETITION FOR A VARIANCE OF ZONE CLASSIFICATION AFFECTING CERTAIN REAL PROPERTY LOCATED AT 49 NORTH THIRD AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. iVHEREAS, on the 23rd day of November, 1949, there was filed with the Planning Commission of the City of Arcadia the petition of Hygiene Products Company, requesting a zoning variance on the following described property, in the City of Arcadia, to wit: Lot 29, Tract No. 6860, as shown on map recorded in Book 78, Page 75 of Maps, Records of Los Angeles County, and located at 49 North Third Avenue, in said City of Arcadia, to permit the above described property to be used for certain business purposes, to wit, a drivewa.y for commercial and other vehicles and as an entrance to the property located immediately west of the aforesaid property; and WHEREAS, the property is now located in a multiple-family zone, to wit, R-3 zone, and WHEREAS, after notice as reqUired by the provisions of Ordinance No. 760, a public hearing on the matter was held before the Planning Commission of the City of Arcadia, on the 15th day of December, 1949, and all interested parties were given a full oppor- tunity to be heard, and \VHEREAS, in the opinion of the Planning Commis- sion the zoning variance that would permit the use of a lot or lots in an R-3 zone for the commercial purposes hereinbefore set forth, would be ootrimental to the public welfare and injurious to surround- ing property, and would adversely affect the comprehensive general plan of this City; and WHEREAS, in the opinion of the Planning Com- mission pUblic necessity and convenience and the general welfare 1. ,,1-,,0 ,,,-0 . do not require or indicate the desirability of the variance requested, and \rrlEREAS, the Planning Commission of the City of Arcadia did recommend in its Resolution No. 20, dated the 19th day of January, 1950, that the aforesaid petition be denied, for the following reasons, to wit: 1. The request of the petitioners is contrary to the spirit and intent of the Master Zoning Plan of the City of Ar- cadia which was adopted and became effective on June 3rd, 1940, after a series of public hearings and which plan was unanimously approved by the Planning Commission and the City Council; 2. A majority of property owners within a 300 foot radius of the property in question, and other property owners in the neighborhood, have objected to any variance that would permit the invasion of business uses into a residential district or zone, such property o~~ers being desirous of, and entitled to, the main- taining of the present residential zoning of the area involved; 3. The Planning Commission considers it inconsistent with good planning practice to encourage or permit heavy trucking and other commercial practices upon or over residential property and to thus circumvent the intent of the Master Zoning Ordinance; and WHEREAS, the aforesaid Resolution No. 20 of the Planning Commission of the City of Arcadia, was adopted by the Com- mission on January 19th, 1950, NOW, THEREFORE, BE IT RESOLVED: SECTION 2. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recommendations of the Planning Commission, as set forth in said Resolution No. 20 of said Planning Commission, and does hereby deny to petitioners the request for re-zoning heretofore described. SECTION 3. The City Clerk shall certify to the 2. adoption of this .Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 7th of February, 1950, by the affirmative vote of at least three Councilmen, .to wit: AYES: Councilmen Boucher, Klomp, Nugent and Russell NOES: None ABSENT: Councilman Libby. ~L, City Clerk of the City / SIGNED AND APPROVED THIS 7th day of February, 1950.
