RESOLUTION NO. 1722 RESOLUTION FINDING CONSTRUCTION OF SANITARY SElffiRS AND APPURTENANCES AND APPURTENANT \{ORK AND PROCEEDINGS THEREFOR NECESSARY AS A HEALTH !iEASURE. ~~REAS, plans and specifications designated Plan No. C-171, consisting of Sheets 1 to 127 inclusive, and Specifi.cations for Sanitary Sewer Improvements Assess- ment District No. W-43, for the construction of sanitary sewers and appurtenances and appurtenant work in the City of Arcadia and extending into the Cities of Pasadena, Monrovia and Sierra Madre, and into unincorporated terri- tory of the County of Los Angeles, were presented to this City Council on October 21, 1947 and approved by said City Council; and ~HEREAS, a report and recommendation of the Health Officer of the County'of Los Angeles (being also the Health Officer of the Cities of Arcadia, ~onrovia and Sierra Madre), determining that the construction of the work and improvement shown on said plans and in said speci- fications, and proceedings for such construction under the Improvement Act of 1911, are necessary as a health measure, has been presented to this City Council; and WHEREAS, the report and recommendation of the Health Officer of the City of Pasadena, determining that the construction of the work and improvement shown on said plans and in said specifications, and proceedings for such lr~' ,-<-" construction under the Improvement Act of 1911, are necessary as a health measure, has been presented to this City Council; and "~REAS, the Board of Supervisors of the County of Los Angeles, the Board of Directors of the City of Pasadena, and the City Council of each of the Cities of Monrovia and Sierra Madre, have given the consent required under Sections ~ 5115 to 5119, inclusive, of the Streets and Highways Code, and each of said legislative bodies has made its findings in accordance with Section 2808 of the Streets and Highways Code, and the recommendation of the Health Officer of the County of Los Angeles, made in accordance with said Section 2808, has been spread upon the minutes of said Board of Supervisors and upon the minutes of the City Council of the City of Monrovia and of the City Council of the City of Sierra Madre, and the recommendation of the Health Officer of the City of Pasadena, made in accordance with said Section 2808, has been spread upon the minutes of the Board of Directors of said City of Pasadena; NOW, THEREFORE, the City Council of the City of Arcadia, California, DOES HEREBY RESOLVE, FIND AND DETERMINE as follows: Section 1. That the recommendation of each of said Health Officers, to wit, the Health Officer of the City of Pasadena and the Health Officer of the County of Los Angeles (being also the Health Officer of the Cities of' Arcadia, Monrovia and Sierra Madre), made to this City Council, be spread upon the minutes of' this City Council. 2. That the construction of the work and improvement. shown upon said plans and in accordance with said specifications is necessary as a health measure; that proceedings for the construction of said work and improve- ment are necessary as a health measure; and that proceedings under the Improvement Act of 1911 for the construction of said work and improvement are necessary as a health measure; and such necessity is hereby found to exist. Section 3. That in view of the foregoing, no steps or proceedings under the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 are required and none shall be taken.
