HomeMy WebLinkAbout1734 .' - RESOLUTION NO. 113 c.t' RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA tUUCING FINDINGS AND OVERRULING PRO~STS AND OBJECTIONS. WHEREAS, this City Council, by its Resolution No. 1725" declared its intention to order the construc- t10n of l:ertain sanitary sewers and appurtenances and appurtenllnt work under the Improvement Aot of 1911, and in said J'esolution fixed 8:00 o'olock P. M.. December 2nd, 1947, in the Council Chambers of this City Counoil, as the t1,me and place for the hearing of protests and objeotions; and VfflEREAS, at the time and plaoe fixed in said resolution a hearing was duly held and all written protests or objeotions were duly read and all persons desiring to be heard thereon were heard, and this City Council gave all persons present an opportunity to be heard in respect of any matter relating to the improve- ments proposed in said Resolution No. 1725 or the boundaries of the assessment district or in any way relating to the proceedings proposed by said resolution of intention, and said hearing was duly continued to the 16th day of December, 1947, at the hour of 8:00 o'clock P. M., in this Council Chamber; and UrnEREAS, all persons desiring to appear and be heard have been heard and this City Council has taken ",\1',,' , evidence relating to the work proposed to be done, the boundaries of the proposed assesament district, and the benefits to the property to be included in the proposed assessment district, and is fully informed in the premises; NOW, THEREFORE, the City Council of the City of Arcadia DOES HEREBY RESOLVE, DE'l'ERMlNE AND OIIDER as follows: Section 1. That the area of all property for which written protests or objections have been filed is approximElte1y .813% of the total area of the property to be assessed for the proposed improvements anti'is less than 1% of such total area. That protests or objections hnve not been made by the owners of one-half of the area of the property to be assessed for the proposed improve- ments. Section 2. That all protests and objeotions, both written and oral, are hereby overruled and denied. Section 3. That no ohanges are to be made in the boundaries of the proposed assessment district or in the wOI~k proposed to be done and the boundaries of the assesllment district are defined and established as the boundllries described in the resclution of intention, to \Tit: Hesolution No. 1725, and the \York proposed to be done ia likewise defined and established as the work described in said Resolution No. 1725. and reference is 2. ." ,\ . .. hereby m.ade to !laid Resolution l~o. :l,725 for /l. tull and complete description of said work and of the assess~ent district and for further particulars.
