HomeMy WebLinkAbout1749 RESOLUTION NO. 1749 A RESOLU1'ION OF THE CITY COUNCIL OF THE CITY OF ARCADIA DECLARING ITS INTENTION TO CONVEY CERTAIN REAL PROPERTY OWNED BY SAID CITY TO THE STATE OF CALIFORNIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLO'llS: SECTION l. \"f.K~~REAS, the City of Arcadia is the owner of a ~ parcel of unimproved land of approximately thirteen acres on Huntington Drive in said city, and WHEREAS, request has been made to the City Council to provide a suitable site therein for use as an Armory by the Cllllifornia Nat:lonal Guard, and WHEREAS, the City Council finds that it is for the best interests of the City of Arcadia and for the public benefit that such a site be so provided by the City of Arcadia; NOW, THERbFORE, BE IT RESOLVED that the City of Arcadia shall grant to the State of California for the use and occupancy of the California National Guard as an prmory site, that certain parcel of land owned by said city, in the City of Arcadia, county of Los Angeles, State of California, and more particularly known and described as: That portion of Lot 5 of Tract No. 949, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 17, Page 13 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point inthe Southeasterly line of said Lot 5, distant thereon, South 380 33' 00" West l773.93 feet from 1;he most Easterly corner of said lot; thence along the Southeasterly line of said lot, South 380 33' 00" West 40.00 feet to the most Easterly corner of the land conveyed to Los Angeles Turf Club by Parcel 2 of the deed recorded in Book l26l9, Page 275, of Officia~ Redords;; thence along the boundary line of the land la st described, the following courses and distances: North 5lo 27' 00" West 30 feet; South 380 3~" 00" West 150 feet and North 5lo 27' 00'" West 481.12 feet to the Southeast- erly line of Huntington Drive as described in the deed to the City of Arcadia, recorded in Book 9396, Page l45, of Official Records;; t hence North 380 33' 00'" East along said Southeasterly line of Huntington Drive, 190.00 feet; thence South 51.0 27' 00" East 5l1.12 feet to the point of beginning, containing 2.126 acres, more or less. BE IT FURTHER RESOLVED that the Mayor and City C:!erk ~ be and they are hereby authorized and directed to execute on behalf of said City of. Arcadia Grant Deed to the aforementioned rea~ property ~n favor of the State of California, subject to: 1. Conditions, restrictions, reservations, easements, rights and rights of way of record, 2. An easement to'Southern California Edison Company for electricity and power, 3. An easement to the Pacific Telephone and Telegraph Company, 4. The further condition that the Armory building proposed to be erected thereon shall be complet~d within five (5) years of the date of the execution of this deed, otherwise the property there- by conveyed shall revert to the City of Arcadia, 5. The further condition that architecture of any building to be erected thereon will be subject to the approval of the City Council of the City of Arcadia, and such building will in all particulars: meet the requirements of the Building Code, 6. The further condition that such building will be made available for civic or public purposes when not required by the units of the California National Guard, subject to the payment of a rental suf- ficient to cover the cost of operation of said building during the period in which it is used for such civic or public purpose, the right being reserved to the armory board to determine when the facilities can be used and as to t he rental charge. SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
