RESOLUTION NO. 1798 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ORDERING CERTAIN TIORK AND lilPROVE1ffiNT TO BE DONE ON PORTIONS OF ALTA S':i'REET;; IN THE CITY OF ARCADIA. THE CITY GOUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require that certain work and improvement be done in the City of Arcadia, and the City CCluncil of the City of Arcadia hereby orders the same to be done in accordance with Specifications and Improvement Plan No. C-174, on file in the office of the City Engineer of said City of Arcadia, adopted for said work and under the direction and to the satisfaction of the Superintendent of Streets of said City of Arcadia; that Resolution of Intention No. 1785 heretofore adopted by this Council on the 6th day of July, 1948, contains a complete description of the work and improvement to be done pursuant to this Resolution, and reference is hereby made to said Resolution of Intention No.1785 for a complete descriptionof said work and improvement. SECTION 2. That the grade to which the work hereinabove des- cribed shall be done and the improvement made as provided in this Resolution is shown on Profile and Improvement Plan No. C-174 on file in the office of the City .t!.ngineer of said City, to which Profile reference is he:reby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accord- ance with said ?rofile and Improvement Plan No. C-174 on file in the office of the City ~ngineer of said City of Arcadia. All work on grading and the construction of concrete gutters shall be in accordancl3 with the following specifications on file in the office of the C~ty Engineer of the City of Arcadia, towit: "Standard Specifications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement". All work OIl the construction of street pavement shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, towit: "Standard Specifi- cations No. 3 for the construction of 2i inch oil maCadam pavement lHf)~!~1 and resurfacing". Said Profile and Improvement Plan No. C-174 and the specifications hereinabove referred to were adopted by Resolution No. 1783 of said City Council of the City of Arcadia, and the same are hereby made a part of this resolution and are hereby referred to for a more particular description of said work. All streets and avenues referBed to in this resomution are public streets and avenues of said City. SECTION 4. That Said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinro'y public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon tblll District which District said City Council hereby declare s to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses ~ereof, which said nistrict shall include all those lots in the said City of Arcadia, fronting on and adjacent to said portion of Alta Street aforesaid. A plat or map of said District indicating by a boundary line the extent of the lands included in sad District was apP:r'oved and adopted by Resolution No. 1784 of the City of Arcadia on the 6th day of July, 1948, and is on file in the office of the City Engineer of the City of Arcadia; reference is hereby madeto said plat or map for a further, full and complete description of said Assessment DistBlct, which said plat or map is designated as Assessment District No. W-~6J and said map so on file shall govern for all details as to the extent of such assess~eUt District. SECTION 5. Said City Council also determines and declares th~ Serial Bonds shall be issued to represent each assessment of Twenty- five dollars ($25.00), or more, remaining unpaid for thirty (30) days after the date of the Warrant to represent the expenses of said work and improvement. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th 60llowing their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of -2- January of each year, following the next October 15th after their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six per cent (6%) per annum on all sums unpaid until the whole of said prin- cipal and interest are paid. Said Bonds and interest thereon shml be payable at the office of the City Treasurer of the City of Arcadia. SECTION 13. All proceedings for the aforesaid work and improve- ment and for '~he issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the LegisJa ture of the State of California, known and designat. ed as the "Improvement Act of 1911, being Division 7, Streets and High0ays Code of the State of California". SECTION ? The Arcadia Tribune and Arcadia News, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice of said work and improvement inviting sealed proposals shall be pub- lished in the manner and form and by the persons reqlired by law. SECTION 8~ the ~ity Clerk of said City of Arcadia ~s hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with the Specifications therefor, inviting sealed proposals or bids for doing said work and said City Clerlll is also directed ~o publish twice in said newspaper designated as afore- said in the maImer and form required by law, a notice inviting sealed proposals or bids for doing said work, and referring to the Specifi- cations posted or on file. Said notice shall require a certified check or bond, either, as prescribed bylaw for an amount not less than ten per cent of the aggregate of the proposal. Sa:id sealed proposals or bids :hall be delivered to the City Clerk of said City of Arcadia on or before eight o'clock P. M., on August 17, 1948; bids will be opened on said day and hour. -3- SECTION 9. The City Clerk shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 3rd day of August, 1948, by the affirmative vote of at least three Co8ncilmen, towit: AYES . .
