HomeMy WebLinkAbout3108 .... ... .. .. .. - .. .. .. RESOLUTION NO. 3108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, URGING THE DEFEAT OF ASSEMBLY BILL NO. 919. WHEREAS, Assembly Bill No. 919 has been introduced at the present session of the California state Legislaturej and, WHEREAS, the law as it now exists permits all or any por- tion of an incorporated city to be placed in the County Fire Protec- tion District and permits the withdrawal of annexed territory from a County Fire Protection District by action of the City Council of the annexing city; and, WHEREAS, Assembly Bill No. 919 as introduced prOVides in part that once the fire protection service of an incorporated city is taken over by the Metropolitan Fire Protection Authority by sim- ple action of a majority of the legislative body of such city, the same cannot be withdrawn from such Metropolitan Fire Protection Au- thority except by a vote of the people; and, WHEREAS, Assembly Bill No. 919 is sponsored by the Feder- ated Fire Fighters of California and is an obvious attempt by said organization to take over all fire protection within the County of Los Angeles; and, WHEREAS, Assembly Bill No. 919 is absolutely contrary in spirit to the principles of home rule which is the very foundation of city government; and, WHEREAS, the only defect in the present law which might be remedied by Assembly Bill No. 919 is that the highly assessed valuation usually present in incorporated cities is, when included within a county fire protection district, assessed at the same -1- 3108 ... ... ... - .. ... .. .. .. - ... .. .. rate as large but low assessed areas of unincorporated territory thereby resulting in the subsidization by highly assessed city properties of large unincorporated areas, which defect can be remedied within the framework of legislation presently in effect; and, ~mEREAS, it has been established that in many incorpo- rated cities it is appreciably less expensive to the taxpayers of such cities to furnish their own fire protection as distinguished from having the same furnished by a consolidated county fire de- partment; NOV1, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, DOES RESOLVE AS FOLLGrlS: SECTION 1. That it is respectfully urged that Assembly Bill No. 919 bE! not adopted by the Legislature of this State, as to do so would be contrary to the interests of a great number of municipalities of this State and would be contrary to the prinCi- ples of home rule so vital to all cities of this State. SECTION 2. The City Clerk shall certify to the adoption of this Resolution and shall cause a certified copy hereof to be forwarded to State Senator Richard Richards, Assemblyman Frank Lanterman, Assemblyman Ernest R. Geddes, Assemblyman Ronald Brooks Cameron, Assemt,lyman George Brown, Assemblyman Clark Bradley, Los Angeles County Supervisor Frank G. Bonelli, and to such other per- sons as the City Council may deem advisable. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 3rd day of March, 1959, by the affirmative vote of at least three Councilmen, to wit: -2- 3108 - .. .. .. .. .. ... .. .. ..
