RESOLUTION NO. 3119
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DENYING AN APPLICATION FOR A VARIANCE
TO PERMIT THE INSTALLATION AND USE OF
MECHANICAL EQUIPMENT IN AN AUTO
LAUNDRY.
THE ::ITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMIN.E AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on August 27, 1958 the application of Fred Kovanen, as
lessee, for a zone variance to permit the installation and use of
mechanical equipment in an existing hand-operated auto laundry upon
the following property in the County of Los Angeles, State of Cali-
fornia, to wit:
Lot 3l, Tract No. 46l1, as shown on map re-
corded in Book 5l, page 82, of Maps, Records
of said County,
located at 1414 South Baldwin Avenue; that after notice as required
by Ordinance No. 760 of said City, as amended, a public hearing was
dUly held by and before said Commission on the lOth day of September,
1958, at which time all interested persons were given a full oppor-
tunity to be heard and to present evidence; which said hearing was
dUly continued to September 23, 1958 for a zoning report; that on
October 14, 1958, said Commission adopted its certain Resolution
No. 313 wherein and whereby certain findings, determinations and
recommendations were made.
SECTION 2. That the City CounCil, upon receipt of said
Resolution No. 313 and the files in the case, did on December 2,
1958, refer the matter back to said Planning Commission for the
reason that certain property owners desiring to protest the grant-
ing of the application did not receive written notice of the hear-
ing thereon. That after notice as required by Ordinance No. 760

of said City, as amended, a public hearing was again duly held on
the matter by and before the Planning Commission on December 23,
1958, at which time said hearing was continued to January 13, 1959,
and still further continued to January 27, 1959, at all of which
times all interested persons were given a full opportunity to pre-
sent evidence and testimony; that on the 24th day of February, 1959,
said Commission adopted its certain Resolution No. 324 wherein and
whereby certain findings, determinations and recommendations were
made.
SECTION 3. That although there were those who spoke in
favor of granting the variance, there were numerous oral protests
and a written protest signed by members of the church in the vi-
cinity; that th'3 basis for said protests was noise and other ob-
jectionable factors associated with mechanical car washes, with the
resultant inconvenience to church services and the interference with
the adjacent residential property; and that the granting of the
variance would oe detrimental to the public health or welfare and
would be injurious to the property or improvements in the vicinity.
SECTION 4. That the property in question is presently
used for a hand operated automobile laundry, which is a proper use
under its present zoning, C-2; that its use for a mechanized auto
laundry would constitute an industrial use in a commercial zone.
That it was not shown that there are any exceptional or extraor-
dinary circumstances or conditions applicable to the property in-
volved or that such requested variance is necessary for preserva-
tion or enjoyment of a substantial property right of the applicant
possessed by other property in the same zone and vicinity. That
the circumstances alleged by the applicant in support of his request
were not such as in the opinion of the Council would warrant the
granting of a variance; that subject property may continue to be

used as in the past and the denial of the requested variance is not
a denial of any property right to which applicant is entitled or
which other owners of property in the vicinity enjoy. That the
granting of the variance will be detrimental to property in the vi-
cinity and that it will adversely affect the comprehensive general
plan, particularly for the reason that it will inject into a grow-
ing commercial area a use which under the provisions of Ordinance
No. 760 of the City of Arcadia, as amended, is classified as an in-
dustrial use.
SECTIC~ 5. That for the foregoing reasons, the applica-
tion of Fred Kovanen for a zone variance to permit the installation
and use of mechanical equipment in an existing hand-operated auto
laundry is hereby denied.
SECTION 6. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 21st day of April
, 1959, by the affirmative vote of
at least three Councilmen, to wit:
