HomeMy WebLinkAbout3126 RESOLUTION NO. 3126 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF WOODRUFF AVENUE AND WOODRUFF PLACE IN THE CITY OF ARCADIA WHEREAS, pursuant to Resolution No. 3117 and the laws and Con- stitution of thel state of California, a public hearing has been held, duly and regularly, on the proposed improvement of Woodruff Avenue and Woodruff Place in the City of Arcadia, by the construction of a sanitary sewer system including man-holes and resurfacing with as- phaltic plant mix where necessary and appurtenant work thereto; and WHEREAS, said improvement has been considered fully; NOli', THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLO\"IS: SECTION 1. That the City Council of the City of Arcadia hereby finds and determines that the public convenience and necessity require the improvement of: Woodruff Avenue between the westerly line of Woodruff Place, a private street, and a point 90 feet ! easterly therefrom and that certain easement lying in and along Woodruff Place, a private street, extending northerly and easterly from Woodruff Avenue, all within the City of Arcadia, by the construction of a sanitary sewer system including man-holes and resurfacing with asphaltic plant mix where necessary and appur- tenant work thereto; and that the nature, location, and extent of the proposed improvement and the district to be assessed for the cost and expenses thereof are shown, respectively, on the prOfile and improvement plan, No. 241; specification entitled: "Improvement of Woodruff Place (Private Street) Northerly From Woodruff Avenue By The Installation of Sanitary Sewers" and assessment district map, No. W-90. SECTION 2. That the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" shall not apply to the making of said improvement. -l- 3126 SECTION 3. That this improvement shall be conducted under the Improvement Act of 1911, which is Division 7 of the Streets and Highways Code of the State of California. The City Engineer and the City Attorney hereby are instructed to present to the City Council the Resolution of Intention required by the Improvement Act to initi- ate the proceedings for the improvement. SECTION 4. The City Clerk shall certify to the adoption of this resolut:l.on, and thenceforth and thereafter the same shall be in full forCE' and effect.
