HomeMy WebLinkAbout3133 RESOLUTION NO. 3133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED ZONE RECLASSIFICATION FROM ZONE R-l TO ZONE R-3 OF CERTAIN REAL PROPERTY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1, That there was filed with the City Planning CommisSion on the 23rd day of February, 1959, the application of the Estate of Otto D, Harris, Deceased, signed by Wm. J. Allen as Execu- tor, for a zone reclassification from Zone R-l to Zone R-3 of the following described real property in the State of California, County of Los Angeles, to wit: Lot 47, Haven Tract, as shown on map recorded in Book 13, pages 22 and 23, of Maps, Records of Los Angeles County, located at 14 East Newman Avenue, That after notice as required by Ordinance No, 760 of the City of Arcadia, as amended, a public hear- ing was duly held by and before said Commission on the 24th day of March, 1959, at which time all interested persons were given a full opportunity to be heard and to present evidence, That upon the con- clusion of said hearing, said Commission adopted its certain Reso- lution No, 328 wherein and whereby it made certain findings and rec- ommendations to this Council, SECTION 2. That there was only one written communication against the granting of the proposed change and no one appeared orally to protest it; however, no one appeared to speak in favor of the change, SECTION 3. That no exceptional or extraordinary circum- stances were shown applicable to the property; that it does not -1- 3133 appear that sueh variance is necessary for the preservation and en- joyment of a substantial property right of the applieant possessed by other property in the same zone and vicinity; that it does not appear that public necessity, convenience, general welfare or good zoning practice justify the rezoning of one single lot, but rather that such a change would be spot zoning, not in the interest of good planning and might adversely affect the comprehensive general plan, SECTION 4, That for the foregoing reasons the request that the above described property be reclassified from Zone R-l to Zone R-3 is hereby denied, SECTION 5, The City Clerk shall certify to the adoption of this resolution.
