HomeMy WebLinkAbout3134 RESOLUTION NO. 3134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED ZONE RECLASSIFICATION FROM ZONE R-l TO ZONES R-2 AND R-3 OF CERTAIN REAL PROPERTY. ' THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE: AND RESOLVE AS FOLLOWS: SECTION 1, That there was filed with the City Planning Commission on the 27th day of January, 1959, the application of R, E, Ellis an([ others, as owners, for a zone reclassification from Zone R-l to Zones R-2 and R-3 of the following described real prop- erty in the State of California, County of Los Angeles, to wit: PARCEL 1. Those portions of Lot 6, Block 89, Santa Anita Tract, as shown on map recorded in Book 34, pages 41 and 42, Miscellaneous Records of Los Angeles County, included within the following described exterior boundary line: Beginning at a point in the north line of Haven Avenue (60 feet wide) distant 146 feet east of the east line of First Avenue (80 feet wide); thence North 140 feet; thence East 4 feet; thence North 100 feet; thence East 126.67 feet; thence South 100 feet; thence East to the westerly line of the right-of-way for Santa Anita \'lash, as de- scribed in Book 11324, page 4, Official Records of said County; thence southeasterly thereon to the south line of said Lot 6; thence west thereon to the northerly prolongation of the west Ifne of Lorena Avenue; thence North 30 feet; thence West 100 feet to the point of beginning, being the property located generally on the extension of Lorena Avenue north of Haven Avenue, to be changed from Zone R-l to Zone R-2, PARCEL 2, Lots 13 to 19 inclusive, Bower's Addition, as shown on map recorded in Book 21, page 47, Miscellaneous Records of said County, being the property located on the west side of Lorena Ave- nue from Numbers 517 to 619 inclusive, to be changed from Zone R-l to Zone R-2. -1- 3134 PARCEL 3, Lots 1 to 12 inclusive, Tract No, 23948, as shown on map recorded in Book 631, page 88, of Maps, Records of said County, being the property located on each side of Haven Avenue and Newman Avenue east of Lorena Avenue, to be changed from Zone R-l to Zone R-2, PARCEL 4, That part of Lot 4, Block 89 of aforesaid Santa Anita Tract, lying west of the aforesaid right- of-way for Santa Anita Wash, excepting the South 135 feet thereof, being the property located at 153 E, Colorado Boulevard, to be changed from Zone R-l to Zone R-2, PARCEL 5. Lots 20 and 21, of aforesaid Bower's Addition, being the property located at 509 and 513 Lorena Avenue, to be changed from Zone R-l to Zone R-3, That after not1.ce as required by Ordinance No. 760 of the City of Arcadia, as amended, a publiC hearing was duly held by and before said Commission on the 24th day of February, 1959, which said hear- ing was continu.ed to March 10, 1959 and still further continued to March 24, 1959, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of said hearings, said Commission adopted its certain Resolution No, 327 wherein and whereby it made certain findings and recommendations to this Council. SECTION 2, That although there were no protests to the requested change of zone, numerous problems would result from the reclassification as requested, such as the need for dedicating and improving a private easement for a public street, the widening of an existing street and providing larger water mains necessary for fire protection. That subject .property is in a subdivision approved and completed within the past year and laid out as single-family lots, SECTION 3. That no exceptional or extraordinary circum- stances were shown applicable to the property. That it does not -2- 3134 ~ '. .. appear that such variance is necessary for the preservation and en- joyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. That there is still much undeveloped R-2 and R-3 property within the City and it does not appear that public necessity, convenience, general wel- fare or good zoning practice justify the requested zone change, but rather tha1; the request is premature, not in the interest of good planning and might adversely affect the comprehensive general plan, SECTION 4. That for the foregoing reasons the request that the above described property be reclassified from Zone R-l to Zones R-2 and R-3 is hereby denied, SECTION 5.
