RESOLUTION NO. 3140
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE TO PERMIT
AN ADDITION TO AN EXISTING MORTUARY.
TI-IE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1, That there was filed with the City Planning Com-
mission on March 31, 1959, the application of Albert J. Miller, as
owner, for a zone variance and/or special use permit to allow an ad-
dition to the existing mortuary located on the following described
property located at 500 South First Avenue in the City of Arcadia,
County of Los Angeles, State of California, to wit:
Lot 36 and the North 10 feet of Lot 35, Block 63t,
Tract No. 866, as shown on map recorded in Book 16,
pages 198 and 199, of Maps, records of Los Angeles
Count;T.
That after notice as required by Ordinance No, 760 of the City of
Arcadia, as amended, a public hearing was duly held by and before
said Commission on April 28, 1959, which hearing was duly continued
to May 12, 1959, at each of which times all interested persons were
given a full opportunity to be heard and to present evidence, That
upon the conclusion of said hearings, said Commission adopted its
certain Resolutlon No, 332, wherein and whereby it made certain
findings and recommendations to this Council,
SECTICN 2, That there was one written protest against the
granting of the variance, but no one appeared at the hearing to
speak either in favor or against said variance.
SECTION 3. That the above described property is zoned C-2,
and the original building was constructed thereon at a time when
mortuaries were a permissible use in Zone C-2. That additions thereto

were made in 1951 and 1954, That Ordinance No. 900, adopted on De-
cember 7, 1954, classified mortuaries as a special use, thus making
the present use of subject property nonconforming. That the pro-
posed addition will not provide extra seating capacity thereby cre-
ating additional traffic, but will afford extra convenience to the
mortuary use, rhat at the time the original building was constructed,
off-street parklng was not required and none was provided, That in
order to comply with the present requirement of one off-street park-
ing space for each four seats provided in the mortuary, applicant
has purchased and proposes to improve Lot 33, Block 63~, Tract No,
866, for off-street parking, and to construct a garage with an apart-
ment over it on said lot. That the reclassification of mortuaries
as a special use and the adoption of off-street parking requirements
constitute exceptional conditions applicable to subject property
and the intended use thereof that do not apply generally to property
in the neighborhood or vicinity, and that a variance and/or special
use permit is necessary for the preservation and enjoyment of a sub-
stantial property right of the applicant possessed by other property
in the vicinity, That the granting of the requested variance and/or
special use perm:Lt upon certain required conditions of off-street
parking will not be materially detrimental to the public health or
welfare or injurious to the property or improvements in the zone or
vicinity where the property is located, nor will it adversely affect
the comprehensive general plan.
SECTIOK 4. That for the foregoing reasons a variance and/
or special use permit is hereby granted to allow an addition which
will provide an attendant's room, a lounge, a toilet and an addition
to the family room located on the northerly side of the existing
mortuary located on the above described property as shown in the
plot plan on file with the Planning Commission upon the condition
that the owner reeord a covenant stipulating the following:

1. ~~hat no further buildings be erected on Lot 33, Block
63~, Tract No, 866, unless and until approved by the Planning Com-
mission,
2, 1~hat within two years after the granting of the within
variance and/or special use permit, the applicant will remove the
present buildings and establish off-street parking on said Lot 33,
such parking to conform with the requirements of the zoning ordi-
nance and be sufficient to fulfill the off-street parking require-
ments applicable to aforesaid Lot 36 and the North 10 feet of said
Lot 35,
3. That the plans for the parking area, showing the pro-
posed layout, number of spaces and access to the lot, with apart-
ments if any, shall be submitted to and approved by the Planning
Commission before any construction is started on the addition to
the mortuary,
SECTION 5. The City Clerk shall certify to the adoption
of this resolut:ion,
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia, held
on the
16th day of

, 1959, by the affirmative vote of
at least three Councilmen, to wit:
