RESOLUTION NO. 3144
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A VARIANCE TO PERMIT THE
CONSTRUCTION OF AN ADDITIONAL
DWELLING.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOI'lS:
SECTION 1. That there was filed with the City Planning
Commission on April 29, 1959, the application of Earl H, Madinger
and Edna V, Madinger, as owners, for a variance to permit the erec-
tion of an additlonal dwelling upon the following described property
located at 910 South Fourth Avenue in the City of Arcadia, County of
Los Angeles, State of California, to wit:
The North 55 feet of the South 260,76 feet of
the West 93.85 feet of Lot 49, Tract No. 808,
as shown on map recorded in Book 16, pages 82
and 83, of Maps, records of said County,
That after notice as required by Ordinance No. 760 of the City of
Arcadia, as amended, a public hearing was duly held by and before
said Commission on May 12, 1959, at which time all interested per-
sons were given a full opportunity to be heard and to present evi-
dence, That upon the conclusion of said hearing, said Commission
adopted its certain Resolution No. 331, wherein and whereby it made
certain findings and recommendations to this Council.
SECTION 2, That there were no protests either oral or
written, to the granting of the variance; that six of the nearest
neighbors signed the petition as favoring the variance and there
were several who spoke in favor of it,
SECTION 3. That the property containing 10,323 square feet
with a 110-foot frontage on Fourth Avenue is zoned R-1. That in 1947
it was divided in.~o two 55-foot lots and is still assessed as two
lot s for t,ax purposes and for the construction of the sewer

system although :Lt was purchased as one lot by applicant in 1948.
That the plans for the proposed house show it to contain 999 square
feet exclusive of porches and garage, and to be located 25 feet
back from the front of the lot instead of the 35-foot setback re-
quired on Fourth Avenue,
SECTION 4. That the foregoing constitute exceptional con-
ditions that do not apply generally to property in the neighborhood
and that a variance is necessary for the preservation and enjoyment
of a substantial property right of the applicant possessed by other
property in the same zone or vicinity, That the granting of a vari-
ance upon the conditions hereinafterc ontained will not be mate-
rially detrimental to the public health or welfare or injurious to
the property or improvements in the zone or vicinity where the
property is located, nor will it adversely affect the comprehensive
general plan.
SECTION 5. That for the foregoing reasons a variance is
hereby granted to permit the construction of an additional house
upon the above dei3cribed property upon the following conditions:
1. That the proposed dwelling be erected at the required
35-foot front setback line,
2, That; the proposed dwelling contain not less than 1,000
square feet exclusive of porches and garage.
3, That the applicant construct the dwelling in accordance
with the plot plan heretofore submitted by applicant and approved by
the Planning Commission.
SECTION 6. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia, held

of at least three Councilmen, to wit:
