HomeMy WebLinkAbout3157 ~ RESOLUTION NO. 3157 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE AND/OR SPECIAL USE PERMIT TO ALLOW THE INSTALLATION AND USE OF A l4-FOOT HIGH COMMERCIAL MASTER TELEVISION ANTENNA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on June 26, 1959, the application of Camden Wilshire Company and Sout.hern California Fringe T.V. Company, as owner and lessee respectively, for a zone variance and/or special use permit to allow the installation and use of a 14-foot high commercial mas- ter television antenna upon the following described property located at 2122 Canyon Road in the City of Arcadia, County of Los Angeles, State of California, to wit: Lot 3, Tract No. 23145, as shown on map re- corded in Book 631, pages 90-92, inclusive, of Map:" records of Los Angeles County. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said CommiSSion on July 14, 1959, at which time all interested per- sons were given a. full opportunity to be heard and to present evi- dence. That upon the conclusion of said hearing, said Commission adopted its certain Resolution No. 338, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That there were no protests, either oral or written, to the granting of the variance and/or special use permit. SECTION 3. That the use of property for a commercial mas- ter antenna is omitted from the lists of uses specified as permis- sible in the various zones designated in Ordinance No. 760 as amended. -1- 3157 .- That the City Planning Commission ascertained all pertinent facts concerning the use of property for a commercial master antenna and, by its Resolution No. 334 adopted June 23, 1959, made its deter- minations and recommendations relative thereto; that thereafter this Council, by its Resolution No. 3152 adopted JUly 7, 1959, de- termined that the use of property for a commercial master antenna should be classified as a special use under Section 17 of Ordinance No. 7bO of the City of Arcadia, and that authority for the location and operation of commercial master antennas should be granted only under the Provisions of and upon compliance with the procedure out- lined for varianees. SECTIm~ 4. That the City has recognized the unique char- acter of the use of property for which the within variance has been requested. That master television antennas must, by their very na- ture and purpose, be erected and operated at locations which will provide adequate television reception and cannot be arbitrarily confined to geographical zones. That this constitutes an excep- tional and extraordinary circumstance applicable to the intended use of subject propeI'ty that does not apply generally to other property and class of uses within the City. That the requested variance and/ or special use permit is necessary for the preservation and enjoy- ment of a property right possessed by other property owners in the City of Arcadia in that the construction and maintenance of a com- mercial master antenna to serve the fringe areas of the City of Ar- cadia is the only feasible method of providing adequate television reception to persons within such fringe areas. That the granting of the requested variance and/or special use permit will not be detrimental to publiC health or welfare or injurious to property or improvements in the zone or vicinity; that it will not be contrary to good planning practice but rather that it will be in harmony therewith as it will eliminate the necessity of individual property -2- 3157 .... owners erecting a multitude of sizeable and unsightly television antennas for their individual use. SECTION 5. That for the foregoing reasons a variance and/ or special use permit is hereby granted to permit the construction, maintenance and operation of a 14-foot high commercial master tele- vision antenna upon the above described property. SECTION 6. The City Clerk shall certify to the adoption of this resolution.
