RESOLUTION NO. 3160
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A VARIANCE TO PERMIT THE
ERECTION OF A THIRD DWELLING ON THE
PROPERTY LOCATED AT 236 WEST FOOTHILL
BOULEVARD IN SAID CITY AND ZONED R-l.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFURNIA,
DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on June 19, 1959, the application of George H. and
Lovetta F. Braun, as owners, for a zone variance to permit the erec-
tion of a third dwelling upon the following described property lo-
cated at 236 West Foothill Boulevard in the City of Arcadia, County
of' Los Angeles.. State of California, to wit:
A part of Lot 6, Tract No. 948, as shown on
map recorded in Book 17, page 21, of Maps,
records of Los Angeles County, described as
follows:
Beginning at the northwest corner of Tract
No. 12374; thence West along the south line
of Foothill Boulevard 150 feet; thence South
0024' East to the northeasterly line of the
A. T. and S. F. Railway right of way; thence
southeasterly thereon to the west line of
said Tract No. 12374; thence North along
said west line to the point of beginning.
That after notice as required by Ordinance No. 760 of the City of
A~cadia, as amended, a publiC hearing was duly held by and before
said Commission on July 14, 1959, at which time all interested per-
sons were given a full opportunity to be heard and to present evi-
dence. That upon the conclusion of said hearing, said Commission
adopted its certain Resolution No. 337, wherein and whereby it made'
certain findings and recommendations to this Council.
SECTION 2. That there were no protests either oral or
wl:'itten to the granting of the variance; that nine property owners
signed the petition favoring the variance, eight of which own

property lying within three hundred ~eet of subject property.
SECTION 3. That subject property presently has two single-
family dwelling units thereon, one occupied by applicant and his
family and the other by his caretaker and family. That the acquisi-
tion by the State of California, Division of Highways, of the right
of way for the proposed Foothill Freeway will eliminate both of said
dwellings, but will leave ample area for the proposed new dwelling.
That the foregoing constitutes an exceptional circumstance applica-
ble to subject property and the intended use thereof that does not
apply generall;Y' to the property in the same zone or vicinity.
SECTlvN 4. That the requested variance is necessary for
the preservation and enjoyment of a substantial property right of
the applicant possessed by other property in the same zone or vi-
cinity, for upon the taking of the right of way for freeway pur-
poses, applicrolt will have no dwelling on the property. That the
requested variance will not be detrimental to other property or im-
provements in the area nor will it be contrary to good planning
practice nor the comprehensive general plan.
SECTION 5. That for the foregoing reasons a variance is
hereby granted to permit the erection of a third single-family
dwelling upon the above-described property upon the following con-
ditions:
a, That it be constructed substantially in accordance
with the plot plan submitted with the application.
b. T~at all kitchen facilities be removed from the
dwelling presently occupied by applicant and his family within
thirty (30) days after occupancy of the new dwelling to be
constructed upon subject property.
c. That prior to commencement of any construction on
subject property applicant execute and record a covenant in
favor of the City of Arcadia declaring that after occupancy

of the new dwelling to be constructed, the dwelling presently
occupied by applicant will. no longer be needed or used as a
separate dwelling unit,
SECTIJN 6. The City Clerk shall certify to the adoption
of this resolution.
I HE~EBY CERTIFY that the foregoing resolution was adopted
adjourned
at a regular/meeting of the City Council of the City of Arcadia,
held on the ll':h day of August, 1959, by the affirmative vote of at
least three CO\illcilmen, to wit:
AYES: Counilmen Balser, Jacobi, Phillips and Reibold
NOES: None
ABSENT: Councilman Camphouse
