HomeMy WebLinkAbout3166 RESOLUTION NO. 3166 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, INSTITUTING PROCEEDINGS FOR, SETTING A PUBLIC HEARING CONCERNING AND GIVING NOTICE OF THE TIME AND PLACE OF SUCH PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION TO THE CITY OF ARCADIA OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CITY LIMITS OF SAID CITY, SAID TERRITORY BEING SITUATED NEAR THE SOUTHERLY PORTION OF THE CITY OF ARCADIA AND DESIGNATED AS "ANNEXATION NO. 19, SOUTH ARCADIA UNINHABITED (REVISED)". THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLO\'iS: SEC'I'ION 1. That pursuant to the "Annexation of Uninhab- ited Territory Act of 1939," as amended, the City Council of the City of Arcadia, on its own motion, does hereby initiate proceed- ings for the annexation to the City of Arcadia of certain uninhab- ited territory contiguous and adjacent to the city limits of the City of Arcadia and situated near the southerly portion of the City of Arcadia as more particularly described in Section 4 hereinafter, SECTION 2. That the City Council of the City of Arcadia desires to annex such uninhabited territory to promote and insure the proper integration of said territory with the contiguous area already within the limits of the City of Arcadia, and to comply with the stated desires of many owners of property in such area. SECTION 3, That the proposal for the annexation of said territory to the City of Arcadia has been submitted to and favor- ably reported upon to the proponents by the Boundary Commission of the County of Los Angeles as required by Section 35002 of the Gov- ernment Code of the State of California. SECTION 4. That the said territory is uninhabited, is -1- 3166 contiguous to the City of Arcadia, and is not a part of any other municipal corporation. SEC'rION 5. That pursuant to the "Annexation of Uninhab- ited Territo~r Act of 1939," as amended, the City Council of the Ci ty of Arcad:.a does hereby give notice of said proposed annexa- tion; that saj.d territory is hereby designated as "Annexation No. 19, South Arc2,dia Uninhabited (Revised)" and is particularly de- scribed and bounded as follows: -2- 3166 "ANNEXATION NO. 19, SOUTH ARCADIA UNINHABITED" TO THE CITY OF ARCADIA (Revised) That certain territory situated in the County of Los Angeles, State of California, which borders on the present boundary line of the City of Arcadia in the vicinity of Live Oak Avenue, bounded and described as follows: Beginning at a point in the southerly boundary of the City of Arcadia as same existed on July 15, 1959, said point lying 230 feet westerly thereon from the northerly prolongation of the center line of El Monte Avenue as said center line is shown on map of Tract No, 13935 recorded in Book 285, pages 13 and 14 of Maps, in the office of the Recorder of Los Angeles County; thence sOl\th- erly, along a line parallel to said center line, to a point 330 feet southerly thereon from the southerly line of Live Oak Avenue 55 feet wide as shown on map of Tract No. 12619 recorded in Book 259, page 42 of Maps in the office of said recorder; thence east- erly, parallel with the southerly line of said Live Oak Avenue, 230 feet more or less to said center line of El Monte Avenue; thence northerly along last mentioned center line to the intersection with the westerly prolongation of the southerly line of the first alley south of Live Oak Avenue in said Tract No, 13935; thence easterly along the southerly line of said alley and prolongations thereof to the westerly line of Arcadia Wash, 80 feet wide shown on said map of Tract No. 13935 as "Proposed Arcadia-Sierra Madre Drainage Chan- nel"; thence northerly along said westerly line to the southerly line of Live Oak Avenue 100 feet wide as shown on said last men- tioned map; thence easterly along said southerly line to the west- erly line of McCulloch Avenue 30 feet wide as shown on said last mentioned map; thence southerly along said westerly line to a point of intersection with the westerly prolongation of the south- erly line of the first alley south of Live Oak Avenue in Tract No. 12049 as per map recorded in Book 224, page 21, of Maps in the of- fice of said recorder; thence easterly along last mentioned pro- longation and southerly line to the westerly line of Lot 1, Tract No. 10260 as per map recorded in Book 219, page 20, of Maps in the office of said recorder; thence southerly along the westerly line of said Lot 1 to the southwest corner thereof; thence easterly along the southerly line of Lots 1, 2 and 3 of said Tract No. 10260 and along its easterly prolongation to the center line of Welland Avenue 60 feet wide as shown on said last mentioned map; thence southerly along said center iine to its intersection with the westerly prolongation of the southerly line of Lot 1 in Block A of Tract No. 10898, as per map recorded in Book 189, page 43, of Maps in the office of said recorder; thence easterly along the last mentioned prolongation and along the southerly line of Lots 1, 2, 3, 4, 5 and 6 in Block A of said Tract No. 10898 to the southwest corner of Lot 7 in Block A of said Tract No. 10898; thence northerly along the westerly line of said Lot 7 to the southerly line of Live Oak Avenue, as same is shown on map of said Tract No. 10898; thence easterly along the southerly line of Live Oak Avenue and along its easterly prolongation to the inter- section with the center line of Double Drive as said last mentioned -3- 3166 center line is shown on map of said Tract No, 10898; thence south- erly along the last mentioned center line to its intersection with the westerly prolongation of the southerly line of Lot 5, Tract No. 11539, as per map recorded in Book 255, page 35, of Maps in the office of said recorder; thence easterly along said prolongation and along the southerly line of said Lot 5 to the westerly line of' Lot 13, Tract No, 15628, as per map recorded in Book 354, page 25, of Maps in the office of said recorder; thence northerly along the westerly line of said Lot 13 to the southerly line of the first alley south of Live Oak Avenue in said Tract No. 15628; thence easterly along the southerly line of said alley and along its east- erly prolongation to the center line of Tyler Avenue 80 feet wide as shown on said last mentioned map; thence southerly along the center line of Tyler Avenue to its intersection with the westerly prolongation of' the northerly line of Lynrose Street, bO feet wide as shown on map of Tract No. 15987 recorded in Book 355, pages 24 to 2b inclusive of Maps in the office of said recorder; thence easterly along last mentioned prolongation and northerly line of said street, easterly along the northerly line of Lynrose Street, 60 feet wide, as shown on map of Tract No, 16286 recorded in Book 373, pages 3 to 6 inclusive of Maps in the office of said recorder, and continuing easterly, northeasterly and northerly along the gen- erally northerly line of Lynrose Street as shown on map of Tract No. 16917 recorded in Book 386, pages 47 to 50 inclusive of Maps in the office of said recorder, to its intersection with the west- erly line of Lenore Avenue, 80 feet wide as shown on said last mentioned map; thence northerly along the westerly line of said avenue to its intersection with the westerly prolongation of the southerly line of the first alley south of Live Oak Avenue in Tract No. 15233 as per map recorded in Book 332, page 30, of Maps in the office of said recorder; thence easterly along last men- tioned prolongation and along the southerly line of said alley to the westerly boundary of the City of Arcadia as same existed on July 15, 1959; thence northerly, easterly, northeasterly, north- westerly, northerly, southwesterly and westerly along the various courses and distances of the boundary of the City of Arcadia as same existed on July 15, 1959, to the point of beginning. -4- 3166 SECTION 6. That the City of Arcadia hereby gives notice of and fixes October 22 ,1959, at the hour of 8:00 o'clock P. M., in the Council Chamber of the Arcadia City Hall, 240 West Huntington Drj.ve, Arcadia, California, as the day, hour and place when and wher~ the City Council of the City of Arcadia will hear protests made by any person owning real property within the terri- tory above described. At any time before the hour set for hearing objections, any owner (as defined by Section 35312 of the California Government Cod8) of property within the above-described territory may file written protest against the annexation. The protest shall state the name of the owner of the property affected and the de- scription and area of the property in general terms. SECTION 7. The City Clerk of the City of Arcadia shall certify to the adoption of this resolution, and shall cause a copy hereof to be pu.blished at least twice, but not oftener than once a week, in the Arcadia Tribune and Arcadia News, a newspaper of gen- eral circulation published in the City of Arcadia, and also in a newspaper of general circulation published outside of the City of Arcadia but in the County of Los Angeles, said publication to be complete at least twenty days prior to the date set for the hearing aforesaid; and ~he City Clerk shall also cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed, is assessed in the last equal- ized county assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of the land in which he has any interest, either legal or equitable, with said City Clerk. In the event any land within the above-described territory is owned by a county, the City ClerJ< shall also cause written notice of such pro- posed annexation to be mailed to the Board of Supervisors of such -5- 3166 county. The written notice by mail shall be given not less than t\~enty days before the first public hearing on said proposed annexa- tion.
