RESOLUTION NO. 3172
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DENYING AN APPLICATION FOR A VARIANCE
TO PERMIT THE CONSTRUCTION OF A
SECOND DWELLING ON PROPERTY LOCATED
AT 903 NORTH SECOND AVENUE AND ZONED
R-1.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on J~ay 12, 1959, the application of David C. and Dorothy
M. Ryder, as owners, for a zone variance to permit the construction
of a second dwelling upon the following described property located
at 903 North S(~cond Avenue in the City of Arcadia, County of Los
Angeles, State of California, to wit:
The South 55 feet of Lot 10, Block 89, Santa
Anita Tract, as shown on map recorded in
Book 34, pages 41 and 42, Miscellaneous Re-
cordfl of Los Angeles County.
That after nottce as required by Ordinance No. 760 of said City, as
amended, a public hearing was duly held on the matter by and before
said Commission on the 14th day of July, 1959, which hearing was con-
tinued to July 28, 1959, at each of which times all interested per-
sons were given a full opportunity to be heard and to present evi-
dence. That upon the conclusion of said hearings, said Commission
did, on July 28, 1959, adopt its certain Resolution No. 339 wherein
and whereby it made certain findings, and recommended to this Coun-
cil that the requested variance be denied.
SECTION 2. That within ten (10) days after aforesaid de-
cision by the Planning Commission, applicant appealed therefrom in
writing to the City Council, pursuant to which appeal a public hear-
ing on the matter was set for, and after due notice was held by and

before this Council on September 1, 1959, at which time all inter-
ested persons were given full opportunity to be heard and to pre-
sent evidence or testimony, and the files and the matter generally
were considered by this Council.
SECTION 3. That although there were no protests to the
granting of the variance and numerous owners in the vicinity signed
petitions favoring the variance, it was not shown that there are
exceptional or extraordinary circumstances applicable to the prop-
erty or its use that do not apply generally to the property in the
same zone and vicinity; nor was it shown that the variance was nec-
essary for the preservation and enjoyment of a substantial property
right of the applicant possessed by other property in the same zone
and vicinity. That it was not shown that the granting of the re-
quested variance would not be injurious to property and improve-
ments in the s~ne vicinity and zone and would not adversely affect
the comprehensive general plan.
SECTION 4. That for the foregoing reasons, the applica-
tion of David C. and Dorothy M. Ryder for a variance to permit the
construction of a second dwelling upon the above described property
is hereby denied.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 15th day of September , 1959, by the affirmative
vote of at least three Councilmen, to wit:
