RESOLUTION NO. 3189
A RESOLUTION OF THE CITY COUNCIL OF
'rHE CITY OF ARCADIA, CALIFORNIA,
CLASSIFYING THE BUSINESSES OF
ELECTRONICS, MACHINE SHOP AND THE
MANUFACTURE, PROCESSING OR TREATMENT
OF PLASTICS AS USES PERMISSIBLE IN
ZONE C-M UNDER ORDINANCE NO. 760 OF
'rHE CITY OF ARCADIA.
WHEREAS, the businesses of electronics, machine shop and
the manufacture, processing or treatment of plastics are nowhere
specifically li:,ted as uses permissible in any zone under Ordinance
No. 760 of the City of Arcadia; and,
WHEREAS, there has been requested a classification of
such businesses under Ordinance No. 760 of the City of Arcadia; and,
WHEREAS, this Council did on December 17, 1957, by Reso-
lution No. 2960 classify the business of mixing, molding and fabri-
cation of plastic products as a use permissible in Zone M-l as recom-
mended by the Arcadia Planning Commission in its Resolution No. 270,
pursuant to a request that such use be classified as a use permis-
sible in Zone M,-l; and,
WHEREAS, under certain conditions and with certain re-
strictions, the business of mixing, molding and fabrication of plas-
tic products could also be a use permissible in Zone C-M; and,
WHEREAS, ambiguity has arisen concerning the appropriate
classification of such use within the meaning and intent of Ordi-
nance No. 760 of the City of Arcadia; and,
WHEREJIS, Sec tion 15-A-l of said Ordinance No. 760 prOVides
in part ". . . if ambiguity arises concerning the appropriate clas-
sification of a particular use within the meaning and intent of this
Ordinance . . . "; and,

WHEREAS, Section 10.1, Subsection A-22, of Ordinance No.
760 permits "Other kinds of manufacture, processing or treatment
of products other than those which may be obnoxious or offensive by
reason of emission of odor, dust, smoke, gas, noise or other similar
characteristics, including hazards, provided that the determination
of the character of any use as defined in this item shall be arrived
at as set forth in Section 15, paragraph A. Use, subparagraph 1,

WHEREAS, at a regular meeting of the City Planning Commis-
sion, said Commission ascertained the pertinent facts concerning the
businesses of electronics, machine shop and the manufacture, process-
ing or treatment of plastics; and,
WHEREAS, the City Council has reviewed said recommendations
and fully considered the matter;
NOW, 'rHEREFORE, THE CITY COUNCIL DOES HEREBY DETERMINE AND
RESOLVE AS FOLLOWS:
SECTION 1. That the businesses of electronics, machine
Shop and the manufacture, processing or treatment of plastics" are
hereby specifically classified as uses permissible in Zone C-M under
Ordinance No. 760 of the City of Arcadia, so long as they are con-
ducted entirely within an enclosed building, if no noise or vibra-
tions resulting therefrom is perceptible on adjacent properties,
and if the same neither causes nor creates odors, dust, smoke, gas
hazards or other similar characteristics obnoxious or offensive to
adjacent properties or to the owners or tenants thereof; and if all

SECTION 2. The Clty Clerk shall certlfy to the adoption
of this resolut:lon.
I HEm~Y CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 1st
day of December , 1959, by the affirmative vote
of at least three Councilmen, to wit:

and Reibold
