HomeMy WebLinkAbout3195 RESOLUTION NO. 3195 A RESOLUTION OF THE CITY COUNCIL OF 'rHE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR A VARIANCE TO PERMIT THE CONSTRUCTION OF AN ADDITIONAL DWELLING ON PROPERTY LOCATED AT 141 WEST COLORADO BOULEVARD. THE C7.TY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on July 16, 1959, the application of Roccie J. and Lor- raine R. Schavon1, as owners, for a zone variance to permit the con- struction of an additional dwelling upon the following described property located at 141 West Colorado Boulevard in the City of Ar- cadia, County of Los Angeles, State of California, to wit: That portion of Lot 1, Tract No. 949, as shown on map recorded in Book 17, page 13, of Maps, records of Los Angeles County, described as follows: Beginning at a point in the north line of Colorado Boulevard distant West thereon 471.34 feet from the northeast line of said lot; thence West on said north line 105 feet; thence North 457.35 feet to the northeast line of said lot; thence southeast thereon 134.04 feet; thence South 374.03 feet to beginning, containing one acre. That after notice as required by Ordinance No. 760 of said City, as amended, a public, hearing was duly held on the matter by and before said Commission on the 11th day of August, 1959, at which time all interested persons were given a full opportunity to be heard and to present evidence, That upon the conclusion of said hearing, said Commission did, on August 25, 1959, adopt its certain Resolution No. 343 wherein and whereby it made certain findings, and recommended to this Council that the requested variance be denied. SECTION 2. That within ten (10) days after aforesaid de- cision by the Planning Commission, applicant appealed therefrom in -1- 3195 writing to the City Council, pursuant to which appeal a public hear- ing on the matter was set for, and after due notice was held by and before this Council on December 1, 1959, at which time all inter- ested persons were given full opportunity to be heard and to pre- sent evidence or testimony, and the files and the matter generally were considered by this Council. SECTION 3. That while seven property owners in the neigh- borhood signed the application as not being opposed to the granting of the variance, no one spoke in favor of it at the hearing and there was one o]~al protest and a written protest from a property owner who had previously signed as not being opposed to the variance. That it was not shown that there are exceptional or extraordinary circumstances applicable to the property or its use that do not ap- ply generally to the property in the same zone and vicinity; nor was it shown that the variance was necessary for the preservation and enjoyment of a substantial property right of the applicant pos- sessed by other property in the same zone and vicinity. That it was not shown that the granting of the requested variance would not be injurious to property and improvements in the same vicinity and zone or would not adversely affect the comprehensive general plan. SECTION 4. That for the foregoing reasons, the applica- tion of Roccie J '. and Lorraine R. Schavoni for a variance to permit the construction of an additional dwelling upon the above described property is hereby denied. SECTION 5. ,The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 15th day of December , 1959, by the affirmative vote of at least three Councilmen, to wit: -2- 3195 . ,...
