AND APPROVING THE ERECTI D

as amended, a PU~liC hearing was duly held by and before said Com-

That while there were no protests to the grant-

ing of the variance, the use of any portion of the premises for a

pharmacy will e2~eed the uses presently or previously allowed by
present and previous zoning regulations applicable in the same vi-
cinity or zone; that such a use would set a precedent for commer-
cial use in the immediate area and is not necessary for the preserva-
ti~n. of substantial property rights of the applicant for the reason
that subject property, at least since the adoption of Ordinance No.
760, has never been usable for such commercial purposes.
SECTIO~ 3. That for the foregoing reasons the application
of the Arcadia P.rofessional Center for a zone variance to allow an
addition to the existing building for the establishment of a phar-
macy therein be and the same is hereby denied.
SECTION 4. That by reason of the deep building setback
line applicable to subject property and the fact that subject prop-
erty abuts a one-,way street, the publiC convenience will be best

served by permitting an identification sign of the size and type and
at the location hereinafter recommended; that the granting of a var~
ance for such sign will not be inconsistent with good planning prac-
.tice nor wit~ the provisions of the master zone plan, nor with the
~
present or prospective development of the neighborhood in which the
property is located, but rather in conformity with each of the fore-
going. That the granting of such a variance will not adversely af-
fect the comprehensive general plan nor will it be materially detri-
mental to property or improvements in the vicinity or zone in which
the property is located.

SECTION 5. That for the foregoing reasons, a zone vari-
ance is hereby granted to permit the construction and maintenance of
an identification sign upon subject property at the location and in
accordance with the design, size, shape and method of construction

to be approved by the Modification Committee of the Planning Com-
mission.
SECTION 6. The City Clerk shall certify to the adoption
of this Resolution.
