'. .....- ....- - ,,, RESOLUTION NO. 3000-A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORN:r:A, GRANTING A ZONE VARIANCE TO PERMIT AN ADDITION AT THE REAR OF AN EXISTING PROFESSIONAL OFFICE BUILDING AT 600 WEST HUNTINGTON DRIVE FOR THE ESTABLISHMENT AND OPERATION OF A PHARMACY THEREIN. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION I. That there was filed with the City Planning Commission on the 20th day of January, 1958, the application of the Arcadia Professional Center, signed by Ralph T. Merriam, President, for a zone variance to allow the construction of an addition at the rear of the existing professional office building to be used for >>, additional medical offices and for the establishment of a prescrip- tion pharmacy therein, at 600 West Huntington Drive on property in ~he City of Arcadia, County of Los Angeles, State of California, described as Lot 13, Tract No. 2828, as shown on map recorded in Book 33, page 63, of Maps, Records of Los Angeles County. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said Com- mission on the 11th day of February, 1958, which said hearing was duly continued to February 25, 1958, at each of which times all per- sons interested were given a full opportunity to be heard and pre- sent evidence. SECTION 2. That there were no protests to the granting of the variance. That Lots 12, 13 and 14 of said Tract No. 2828 are ol. and for some time have been under common ownership, and all three lots are zoned R-3. That the first unit of the medical building was constructed on Lot 14 to the east of subject property at a time when .,.1- J. ... 3000- A \ ..j --~ ,r - ,~. medical buildings were a permissible use in the R-3 zone; that the second unit of the medical building was constructed on subject prop- erty under the terms of a variance granted by the City Council by Resolution No. 2604 adopted on June 21, 1955; SECTION 3. That the proposed additional medical offices are similar to those now existing on the subject property, and both the existing buildings and the proposed addition thereto conform to the present provisions of the C-O Zone; that until the adoption of Ordinance No. 900, subject property could lawfully be used for the construction, maintenance ahd operation of a medical office; that the applicant is the owner of properties adjacent to subject property, all of which properties were acquired for the purpose of and planned for their full utilization as a medical office center. That a large part of this plan had been completed prior to the adoption of Ordi- nance No. 900 which removed medical offices from the list of uses permissible in Zone R-3. -" SECTION 4. That pharmacy is now recognized as a profession. That the doctors already occupying the premises may, both under state and local law, compound prescriptions for their patients; that such compounding of ,prescriptions can be more efficiently conducted at one location by a registered pharmicist than can be done individually by the several doctors using the premises. That a central prescrip- tion pharmacy could be of great convenience to doctors and patients alike. .-: SECTION 5. That the granting of a variance to allow the construction and use of additional medical offices upon the property and to allow the construction and operation of a prescription pharm- acy handling only nledicinal and home sickroom supplies and prescrip- tions, and surgical and post operative supplies and appliance~upon the conditions hereinafter set forth will not be inconsistent with , ,,- -2- 3000-/1 .. . ;.' ~ I, .,- - ... .r . . good planning practice nor with the provisions of the master zon- ing plan, nor with the present nor prospective development of the neighborhood in which the property is located, but rather will be in conformity with each of the foregoing. That the granting of such a variance will not adversely affect the comprehensive general plan nor will it be materially detrimental to property or improvements in the vicinity or zone in which the property is located. That the granting of such a variance is necessary for the preservation of substantial property rights of the applicant. SECTION 6. That for the foregoing reasons a variance is hereby granted to permit the property described in Section I here- inabove to be used for the construction of an addition to the rear of the existing professional office building on subject property, to be used for additional medical offices and for the establishment and conduct of a prescription pharmacy therein, upon the following terms and conditions: a. That subject property shall be used only for those uses in Sections cl, e, f, i, j, k, I and n of Section 8.I-A-2 of Ordinance No. 760 as amended by Ordinance No. 900, or Subsections d, e, f, h, i, j, k and 1 of Section 8.1-A-2 of Ordinance No. 760 as amended by Ordinance No. 1001; b. That the prescription pharmacy shall handle only me- dicinal and home sickroom supplies and prescriptions, and surgical and post operative supplies; that the sale of candy, papers, maga- zines, tobacco and all other sundries be prohibited; c. That the prescription pharmacy be conducted within the area designated on the plot plan as submitted by applicant; that said area be n.either changed nor enlarged. SECTION 7.
