A RESOLUTION OF THE CITY COUNCIL OF
THE CI:TY OF ARCAD:r:A, CALIFORN:r:A,
DETERMINING THAT THE PUBLIC WELFARE,
CONVENIENCE AND NECESSITY REQUIRE
THE ACQUISITION OF CERTAIN REAL
PROPERTY FOR A PUBLIC PURPOSE, TO
WIT, THE CONSTRUCTION OF A NEW
WATER RESERVOIR.
THE CITY COUNCIL OF THE CITY OF ARCAD:r:A, CALIFORN:r:A, DOES
HEREBY RESOLVE AS FOu.oWS:
SECTION 1. That the City Council finds, determines and
declares that the public welfare, convenience, interest and neces-
sity require the acquisition of the real property hereinafter de-
scribed for the purpose of constructing a water reservoir upon said
property, to become a part of and to be used in connection with the
water production.,' storage and distribution system owned and operated

by the City of Arcadia for the supplying of water to the inhabitants
and properties of the City of Arcadia. That the City of Arcadia is
a muniCipal corporation, to wit, a charter city in the County of Los
Angeles, state of California. That the purpose for which it is pro-
posed to acquire the property hereinafter described is a public pur-
pose; that the acquisition of said property and the construction of
a water reservoir thereon is a public improvement; and that such
public improvement has been planned and located in a manner that is
compatible with the greatest public good and the least private injury;
that the acquisition of the property hereinafter described for the
purposes hereinbefore set forth is authorized by law.

SECTION 2. That the City Council of the City of Arcadia
hereby finds, determines and declares that the pUblic interest and
necessity require, for the purposes hereinbefore set forth, the ac-
quisition by the Gity of Arcadia, in its name, of the real property

and the interests in the real property hereinafter described and the
City Council hereby declares that it is the intention of the City of
Arcadia to acquire in its name by condemnation, in accordance with
the provisions of the Code of Civil Procedure and of the Constitution
of the state of California authorizing the exercise of the right of
eminent domain by a city, the real property and the interests in the
real property he:reinafter described for the purposes hereinbefore set
forth.

SECTION 3. That the City Attorney of the City of Arcadia
be and he is hereby authorized, empowered and directed to prepare,
institute and prosecute in the name of the City of Arcadia, such
proceedings in the proper court having jurisdiction thereof as are
necessary for such acquisition; and for such purpose he is authorized
to employ such legal counsel and assistance, including qualified ap-
praisers, as he deems necessary and to take any and all necessary
or proper action, including the opening of escrows for the acquisi-
tion of said property.

SECTION 4. That the real property or interests in real
property which the City of Arcadia proposes to acquire and by this
resolution declares necessary to acquire for the purposes herein-
before set forth and for the acquisition of which the City Attorney
of the City of Arcadia is by this resolution authorized, empowered
and directed to prepare, institute and prosecute proceedings, is the
fee title in and to the real property more particularly described as
follows:

That certain real property situated within the City ot
Sierra Madre, County ot Los Angeles, State ot California, being a
portion ot the Southeast quarter of Section 16, Township 1 North,
. Range 11 West, S" B. B. 8: M., described as tollows:
Beginning at a point in the westerly line ot Santa Anita
Canyon Road as per deed recorded in Book 11036, Page 149, Otficial
Records of said County, said point being North 0054105" West,
860.00 feet trom the northerly line of Grand View Avenue. as shown
on Map of Santa Anita Tract, recorded in Book 34, Pages 41 and 42,
Miscellaneous Records of said County; said point of beginning be-
ing alao the southeaster~y corner of that land conveyed to the City
ot Arcadia by deed recorded in Book 7351, Page 106 of Deeds, Re-
cords of said County; thence South 890281l5" West, 172.71 feet
along the southerly line of aforementioned land; thence North
0054105" West, 136.00 feet alonf5 the easterly line of that land
~ conveyed to Florence S. Gustin by deed recorded in Book 20754,
Page 230 of Deeds, Records of said County; thence South 89028115"
West, 131.98 feet to the westerly line ot aforementioned land,
said westerly line being also the easterly line ot Tract 17951;
thence South 002l150" East, 191.00 feet along said westerly line;
thence North 89028115" East, 306.48 feet to the said westerly line
of Santa Anita Canyon Road; thence North 0054'05" we~t, 55.00 teet
along the said westerly line ot Santa Anita Canyon Road to the
point of beginning.

SECTION 5. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia, held
on the 15th day of April, 1958, by the affirmative vote of at least
three Councilmen, to wit:
