A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE FOR A
COMMERCIAL BUILDING AND AUTOMOBILE
PA.RKING AFFECTING PROPERTY AT SANTA
ANITA AVENUE AND LAS TUNAS DRIVE.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on the 27th day of January, 1958, the application of

Vivian J. Margolin, as owner, for a zone variance to permit property
located at the northwest corner of Santa Anita Avenue and Las Tunas
Drive to be developed and used as follows: '

A portion of Lot 66~ Santa Anita Colony, as shown
on map recorded in Book 42, page 87, Miscellane-
ous Records of Los Angeles County, described as

Tunas Drive; thence southeasterly thereon to its
intersection with a line distant east 103 feet
(measured at right angles) from the west line of

point of beginning,
for purposes permitted in Zone PR-l. That after notice as required
by Ordinance No. 760 of the City of Arcadia, as amended, a public
hearing was duly held by and before said Commission on February 25,
1958, which said hearing was duly continued to March 11, 1958, at
each of which times all interested persons were given a full oppOP-
tunity to be heard and to present evidence. That upon. the conclu-
sion of said hearing, said Commission adopted its certain Resolution
No. 279, wherein and whereby it made certain.findings and recommen-
dations to this Council.
SECTION 2. That there were protests both oral and written,
to the granting of the variance and there were those who'spoke in
,favor of the, request.

SECTION 3. That subject property is presently zoned R-l,
R-2 and Rood, wi.th asman portion zoned PR-3, and has been so zoned
for some time past without any development under such zoning; that
property abutting subject property on the south is zoned C-3; that
property across Las Tunas Drive in the city is zoned C-2 andprop~
.erty on the .south side of Live Oak Avenue in county territory is
zoned for commercial purposes.
SECTION 4. That the development of the property under a
variance into a good shopping center wit~ adequate parking space,
under certain ~onditions, will not be inconsistent with good plan-
ning practice nor with the provisions of the master zoning plan;
nor with the present or prospective development of the neighborhood

in which the property is located, but rather will be in conformity
with each of the foregoing. That the granting of such a variance
will not adversely affect the comprehensive general plan nor will
it be materially detrimental to property or improvements in the
vicinity or zone in which the property is located. That the grant-
ing of such a variance is necessary for the preservation of sub-
stantial property , rights of the applicant.
SECTIru~ 5. That for the foregoing'reasons, a variance is
~ hereby granted to permit the erection of a commercia~ building on
the property des~ribed as Parcel 1 hereinabove, and for the use of
the property described as Parcel 2 hereinabove for automobile park-
ing purposes upon the following conditions:
a. All buildings and parking areas shall be initially
constructed and thereafter at all times throughout the duration or
use of the variance hereby granted be maintained in substantial
compliance with the plot plan and sketches approved by the City
Council on May :~9, 1958, and modified only to the extent as may

hereinafter be required. The final construction plans shall first
be approved by the City Council after report thereon by the Planning
, Commission.
b. The construction of the improvements shall start within
six months of the effective date of the variance hereby granted, and
shall be completed within three years after such date.
c. A planting area ten feet wide shall be maintained along
the east side of Lots 13 and 14, Tract No. 13540, per map recorded
in Book 277, pages 11 and 12, of Maps, and across the present east
end of Sandra Avenue. Such area must be at all times maintained as
a planting area, free and clear of weeds and debris, by the owner of
the property. Portions of such 10-foot strip may be sold or conveyed
to the owners of the property immediately to the west thereof, and

upon such conveyance or sale, the obligation of the owners of the
property remaining to the east to maintain the same shall there-
upon cease with respect to the portions thus sold or conveyed.
d. A six-foot high wall shall be constructed along the
east side of Lot 35, Tract No. 13540; along the south and east side
of the planting area; along the north line of the property adjacent
to the rear line of the lots facing Woodruff Avenue; and along the
west and south line of the Arcadia Congregational Church property
abutting the subject property on the north; the height of such wall
to be stepped do~m from six feet to three feet, for a distance of
twenty-five feet from Las Tunas Drive and from Santa Anita Avenue.
Such wall shall be constructed as soon as the subject property is
graded and shall be completed prior to the construction of any im-
provements on the balance of subject property other than founda-
tions.

e. No structures other than the required block wall and
ground surface parking facilities shall at any time be constructed
or maintained on the North 117.5 feet of the property mentioned,
measured at right angles to the northerly line thereof.
f. All storage of goods, wares, merchandise, materials,
crates, waste materials and rubbish shall at all times be conducted
within the enclosed building, and not outside.
g. All outside lights shall be directed away from adja-
cent residential property. A six-foot high solid masonry wan shall
be provided aro~nd the roof parking area to provide safety to the
cars using such area.
h. No illuminated signs shall be placed or maintained on
the west and north sides of the building.
i.. The ramp to the roof parking lot shall be sound-con-
trolled to the :satisfaction of the Director of Public Works.
j. The owners of the Arcadia Congregational Church prop-
erty and the ow~ers of subject property shall resolve any problems
of water line easement that may exist on the above-described property.

k. Each condition of this variance shall be interde-
pendent upon the other and the violation of anyone or more con-
ditions shall constitute grounds for the revocation or modification
of the variance hereby granted. Each condition shall continue to
be in full force and effect throughout the duration and use of the
variance hereby granted.
SECTION 6. The within variance is hereby granted upon
the condition that the following described property owned by appli-

cant will at all times be developed, maintained and used in the
manner and for the purposes specified in the application for the
variance. as .modi:ried by the Council's action; that applicant is
presently the owner of the following described property, to wit:
A portion of Lots 66 and 69, Santa Anita
Colon~, as shown on map recorded in Book 42,
page 87, Miscellaneous Records of Los Angeles
County, described as follows:

said Lot 66 distant South 0000'15" West 235.00
feet from the northeast corner of. said lot,
said point being in the west line of Santa
Anita Avenue, 100 feet wide; thence South
0000'15" West along the east line of Lots 66
and 69 to a point which is distant North 0000'15"
East 107.17 feet from. the northerly terminus of
a curve in the west line of Santa Anita Avenue
concave to the mo~t~and having a radius of
15.00 feet and a length. of 21.21 feet; thence
South 83049'24" West 150.00 feet; thence South.
0000'15" West 120.00 feet to the north line of
Las Tunas Drive; thence westerly and northwesterly
thereon to the west line of said Lot 66; thence
north on said west line to the northwest corner
of said Lot 66; thence South 89059'30" East along
the north line of said Lot 66 a.distance of 525
feet; thence South 0000'15" West 117.5 feet;
thence South 65017'35" East 137.59 feet; thence
South 89059'30" .East 425.00 feet to the point of
beginning,

and all of the above-described property shall be developed within
three Years after the date hereof and throughout the duration and
use of the variance hereby granted shan be maintained and used
substantially in accordance with the plot plan and sketches ap-
proved by the City Council on May 29, 1958, and the variance here-

SECTION 7. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting ofrthe City Council of the City of Arcadia held
on the 17th day of June

least three Councilmen, to wit:
