HomeMy WebLinkAbout3037 , RESOLUTION NO. 3037 . ,A RESOLUTION OF' THE CITY COuNCIL OF THE CITY OF ARCADIA, CALIFORNIA, , GRANTING A ZONE VARIANCE,TO PERMIT 'THE CONSTRUCTION OF AN ADDITIONAL , DWELLING AT 535 WESr LEMON AVENUE. THE CITY COUNCIL OF THE CITY OF ARCADIA~ CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning ... Commission on Apri.l 2, 1958, the application of Richard M; and Norma G. Canzoneri, as owners, for a zone variance to permit the erection of one ad.ditional dwelling on the rear portion of the fol- ,lowing described property in the County of Los Angeles, state of, California, to wit: The west 71.41 feet of the south 234.33 feet of Lot 48, Tract No. 4869, per map recorded in, Book 52, page 13, of Maps, 'Records of said County" located at 535 We8t Lemon Avenue. ,That after notice as required by ... Ordinance No. 760 of the City of Arcadia, as amended, a public hear- ing was duly held'by and before said 'commission on April 22, 1958, which said hearing,was duly continued to May 13,.1958, at each of which times all interested persons were.gi-ven a ;full opportunity to be heard and to present evidence. That upon the conclusion of said hearing, said Commission adopted its certain Resolution No. 290, wherein and ~lhereby it made certain findings and,recommenda- tions to this Council. SECTION 2. That there were no protests, either oral or written, to the granting of the variance, but that several neighbors approved in writing the granting of the petition and several spoke in favor of it. SECTION 3. That su~ject property was purchased in May lIl- of 1957 with the :lntention of constructing an additional dwelling -1- 3037 thereon in the immediate future; but that on August "20, 1957, Ordi- nance No. 990 was adopted which precluded construction of the addi- tional dwelling ttiereon. rhat the foregoing constitutes an excep- tional circumstance applicable to subject property and the intended use thereof that does not apply generally to the property in the same zone or vicinity. SECTION h. That subject property contains 16,733 square feet with a depth of 234.56 'fee't. That although properties at the rear of subject property have already been resubdivid~d, there is no practical means of resubdividing subject property so as t9 per- mit the construction of additional dwellings thereon. That 'thirteen lots on the sam~ s:lde of the street, within the same block as sub- ,ject property, have been developed into two or more dwellings. That the two lots adjac1ent to subject property on the west have beenim- proved with more than one dwelling. That lots directly across the street from subject property have been improved with more than one 'f'- dwelling. ,That within 300 feet of subject pr9perty 'there are twenty .. lots other than SUbject property, eleven of which, or 55% thereof, are now developed with two or more dwellings. That the requested ,variance is therefore necessary for the preservation and enjoyment of substantial property rights of the, applicant possessed by other property in the same vicinity and zone. SECTION 5. That the granting of ,the variance as herein- ~fter recommended will not be materially detrimental to the public . general plan. " , SECTION 6; That for the foregoing reasons a variance is hereby granted to permit the erection of an additional dwelling on ~, .' .,.2- 3037 ~ the property hereinabove described upon 'the fol19wi~g conditions:' a., That the additional dwelling contain at least 1,000 - . . . square feet of floor area as is,required for dwellings in Zone R-l. b. That said additional dwelling comply with all of the regulations applicable to dwellings in Zone R-l. c. That said additional dwelling comply substantially with the plot plan, plans and elevations submitted with the appli- cation. d. That a solid masonry wall, at least five feet in Oc height, be maintained across the rear property line; pr9vided, how- ever, that the continued maintenance of the existing solid masonry wall en the rear property line of the adjacent property to the rear of subject property shall be deemed compliance with this condition. SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
