HomeMy WebLinkAbout3041 ~ RESOLUTION NO. 3041 A,RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED ZONE RECLASSIFICATION OF CERTAIN REAL PROPERTY . THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on the 17th day of January, 1958, the application of .- Herbert W. Ambs and others, as owners, for a zone reclassification '" from Zone ,R-l to Zone R-3 of the following described real property in:the State of California, County of Los Angeles, to wit: Lots 3 to 6 inclusive; the west 50 feet of . Lot 15; Lots 16 to 20 inclusive; Lots 27, 28 and 29; Lots 36 to 43 inclusive, Tract No. 6641 as shoWn on map recorded in Book 126, page 67, of Maps, Records of said County, located in the. general vicinity of Baldwiri Avenue and Las Tunas Drive, extending east approximately 600 feet from Baldwin Avenue. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said Commission on the 25th day of March, 1958, which said hearing, ,at the request of the applicant, was continued to April 22, 1958 and still further continued to May 13, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of said hearings, said Commission adopted its certain Resolution No. 288 wherein and whereby it made certain findings and recommendations to thisCoun- cil. SECTION 2. That in addition to many oral protests, written protests to such rezoning were filed by the owners of more than one ;' -1- 3041 ... hundred parcels in the general neighborhood, on the grounds that the proposed use of apartment houses would create noise and park- ing problems in a quiet single-family residential neighborhood thereby reducing property values. That although the'applicant re- quested a continuation of the hearing set for March 25,1958 for the purpose of filing the amended application, no such amendment was filed and the petition filed on April 18, 1958 requesting that a portion of the original area,be excluded from the application was not signed by the owners of all the property for which exclu- --r sion was requested. That the petition, as originally filed, re- quested rezoning on only one side,of Woodruff and Workman Avenues leaving R-l zoning at the'southwest corner of Woodruff Avenue and Baldwin'Avenue with a probability of further applications for zon- ing relief. That even with the requested exclusion of some area~, the petition still proposed R-3 zoning on the north side of Las Tunas Drive across the street from Zones C-l and R-l, resulting in an island of R-3 zoning of Baldwin Avenue without regard to other properties. ~ SECTION 2. That no exceptional or extraordinary circum- stances were shown applicable to the property. That it was not shown that pubiic necessity, convenience, general welfare or good zoning practife justify the requested zone change but rather that the request is premature and not in the interest of good planning and would be'detrimental to the residential property in the neigh~ borhood. SECTION 3. That for the foregoing reasons the request that the above described property be reclassified from Zone R-l to Zone R-3 is hereby denied. SECTION 4.
