OF THE CITY OF ARCADIA SETTING A HEARING FOR THE PURPOSE OF DETERMINING \rnETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF FOURTH AVENUE BETVlEEN THE CENTER LINE OF NORMAN AVENUE AND A POINT 200 FEET ! SOUTH OF CAMINO REAL AVENUE IN THE CITY OF ARCADIA WHEREAS, Section 17 of Article XIII of the Constitution of the State of California prOVides that the debt limitation and majority protest provisions of said section shall not apply if, after the ~ giving of such reasonaoe notice by publication and posting and the holding of such public hearing as the City Council of the City of Arcadia shall have prescribed, said council, by no less than a 4/5ths vote of all members thereof, finds and determines that the public convenience and necessity require the improvement proposed to be madej and WHEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the "Special Assessment Investi- . gation, Limitation and Majority Protest Act of 1931" shall not apply to any proceeding otherwise subject thereto when said im- provement proceeding is by a charter city and said city has com- plied with the pI'ovisions of Section 17 of Article XIII of the Constitution of the State of Californiaj and WHEREAS, the City of Arcadia is a charter city of the state of Californiaj NOW, THEREFORE, THE CITY COUNCn. OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLO~rs: SECTION 1. That said City Council proposes to initiate L proceedings for the improvement of Fourth Avenue between the center + line of Norman Avenue and a point 200 feet ~ south of Camino Real Avenue within the City of Arcadia, by the installation and construc- tion of sanitary sewers and appurtenant work thereto. The nature, -- -1- 3047 , > .... location, and extent of the proposed improvement and the district to be assessed for the cost and expenses thereof are as shown re- spectively on the plan and profile No. 238 adopted by the City Council of the Ci.ty of Arcadia by Resolution No. 3045 on August 19, 1958, and assessment 'district map No. W-71 adopted by said city council by Resolution No. 3046 on August 19, 1958, and in accordance with specification entitled "Improvement of Fourth Avenue from Camino Real Avenue to Norman Avenue for Installation of Sanitary Sewers~, which said specification duly was adopted by said City Council by Resolution No. 3045 on the 19th day of August, 1958, which said plan and profile, assessment district map, and specification now are on file in the offices of the City Engineer and of the City Clerk of said city, to which said plan and profile, assessment district map, and specification reference is made for all particulars relative thereto. SECTION 2. That the total estimated cost of the proposed improvement is $3,495.80. SECTION 3. That the said improvement shall be conducted under the Improvement Act of 1911, which is Division 7 of the streets and Highways Code of the State of California. SECTION 4. That notice hereby is given that on the 16th day of September, 1958, at 8:00 P.M., in the Council Chamber located in the City Hall of said city, there shall be a publiC hearing be- fore said City Council for the purpose of determining whether the public convenienl}e and necessity require the above described im- provement. '.. SECTION 5. That the City Clerk shall give notice of the hearing by posting a copy of this resolution in the manner pre- scribed by Section 5065 of the streets and Highways Code and by publication as h(~reinafter provided. Any person interested may malce protest against the proposed improvement in writing filed with the $ -2- 3047 ~ City Clerk at any time not later than the hour set for the hearing in the manner provided by Section 5220 of the Streets and Highways Code. SECTION 6. That the City Clerk hereby is directed to publish this resolution in the "Arcadia Tribune and Arcadia News~ on two successive dates, the first publication to be made not less than ten (10) days prior to the date of the above public he~ing. SECTION 7. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall + be in full force and effect. 19thday of August ,1958.
