A RESOLUTION OF Tflli CITY COUNCIL OF
Trffi CITY OF ARCADIA, CALIFORNIA,
GfUlliTING A ZONE VARIANCE TO PERMIT
, TIill CONSTRUCTION OF THREE ADDITIONAL
DVIELLINGS ON, CERTAIN REAL PROPERTY
IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA" CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOWS:

SECTION 1. That there was filed with the City Planning
Commission on'Jwle, 10, 1958 the application of Farley H. Archer
and Elaine Archer, as owners, for a zone variance to permit the
erection of one additional house on the front portion of the south
half and two additional dwellings on the north half of certain real
property in the County of Los Angeles, State of California, de-
scribed as follows,:
The south ll4.06 feet of the west 287.89
feet of Lot 20, F. A. Geier Tract, as
shown on map recorded in Book 23, page 40,
of Map:3, Records of said County,
- located at 1070 and 1080 South lOth Avenue. That after notice as
required by Ordinance No. 760 of the City of Arcadia, as amended,
a public hearing was duly held by and before said Commission on
June 24, 1958t which said he1l:ring was duly continued to July 8,
1958, at each of which times all interested persons were given a
tullopportunity to be heard and to present', 'evidence. That upon
, the conciusion of said hearirigs, said Commission adopted its cer-
tain Resolution No. 303, wherein and whereby it made certain find-
ings and recommendations to this Council.
SECTION 2. That there were no protests, either oral or
written, to the granting of the variance.
SECTION 3. That subject property is a lot ll4.06 feet
wide and 287.89 feet deep, containing 32,836 square feet, with an
.r old nonconformi~; duplex on the, north half and a single residence

on the rear portion of the south half, constituting exceptional
circumstances applicable to subject property that do not apply gen-
erally to property in the same zone or vicinity. That permission
to divide the property into two 57-foot lots was approved by the
Council on July 1, 1958 under certain conditions, one of which was
the removal of the duplex on the north half of subject property.

SECTION 4. That at the present time there are ten lots
on the east side of lOth Avenue in this block, of which six now
have two or more houses, thus conforming to the sixty percent re-
quirement of Ordinance No. 990 for the erection of additional
housesj however, after this property is divided and the duplex re-
moved, there will be eleven lots of which five have two or more
houses thus no longer meeting the required sixty percent. That
within 300 feet of'the subject property there are seventeen lots
facing lOth Avenue of which five now have two or more houses.
That the requested variance is therefore necessary for the preser-
vation and enjo~ment of substantial property rights of the appli-
.cant possessed by other property in the same vicinity and zone.

SECTION 5. That the granting of the variance as herein-
after recommende'd will not be materially detrimental to the public
welfare, nor injurious to the property or improvements in the same
vicinity and zone, nor will it adversely affect the comprehensive
general plan.
SECTION 6; That for the foregoing reasons a variance is
hereby granted to permit the erection of three additional dwellings
on the property hereinabove ,described upon the following conditions:
a. That all the conditions of the lot split of subject
property approved by the Council on July 1, 1958' as Lot Split No. 211

b. That the construction of the three new houses shall

be started within six months from the effective date of the vari-
ance and shall be completed within one year after start of con-
'struction;
c. That all improvements shall comply with all the re-
quirements of all applicable,ordinances.

, SECTION 7. The City Clerk shall certify to the adoption

,of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 16th day of September ,1958, by the affirmative vote of
at least three Councilmen, to wit:
