HomeMy WebLinkAbout3056 RESOLUTION NO. 3056 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA SETTING A HEARING FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF FOURTH AVENUE BETWEEN THE CENTER LINE 9F NORMAN AVENUE AND A POINT 200 FEET _ SOUTH OF CAMINO REAL AVENUE IN THE CITY OF ARCADIA. +- WHEREAS, Section 17 of. Article XIII of the Constitution of the State of California provides that the debt limitation and majority protest provisions of said section shall not apply if, after the giving of such reasonable notice by publication and post- ing and the holding of such public hearing as the City Council of the City of Arcadia shall have prescribed, said council, by no less than a 4/Sths vote of all members thereof, finds and determines that the public convenience and necessity require the improvement pro- posed to be made; and, l' WHEREAS, Section 2804 of the Streets and Highways Code of the State of California prOVides that the "Special Assessment In- vestigation, Limitation and Majority Protest Act of 1931" shall not apply to any proceeding otherwise subject thereto when said im- provement proceeding is by a charter city and said city has com- plied with the proviSions of Section 17 of Article XIII of the Constitution of the State of California; and, WHEREAS, the City of Arcadia is a charter city of the State of California; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That said City Council proposes to initiate proceedings for the improvement of Fourth Avenue between the cen- ter line of NOl~an Avenue and a point 200 feet t south of Camino Real Avenue within the City of Arcadia, by the installation and construction of sanitary sewers and appurtenant work thereto. ". ~> -1- ,3056 +' nature, location, and extent of the proposed,improvemert and the district to be assessed for the cost and expenses thereof are as shown respectively on the plan and profile No. 238 adopted by the City Council of the City of Arcadia by Resolution No. 3045 on Aug- ust 19, 1958, and assessment district map No. W-71 adopted by said city council by, Resolution No. 3046 on August 19, 1958, and in ac- cordance with specification entitled "Improvement of Fourth Avenue from Camino Real Avenue to Norman Avenue for Installation of Sani- tary Sewers", which said specification duly was adopted by said City Council by Resolution No. 3045 on the 19th day of August, 1958, which said plan and profile, assessment district map, and specifi- cation now are on file in the offices of the City Engineer and of the City Clerk of said city, to which said plan and profile, assess- ment district map, and specification reference is made for all par- ticulars relative thereto. SECTION 2. That the total estimated cost of the proposed improvement is $4,849.80. SECTION 3. That the said improvement shall be conducted under the Improvement Act of 1911, which is Division 7 of the Streets and Hil~hways Code of the State of California. SECTION 4. That notice hereby is, given that on the 7 th day of October, 1958, at 8:00 P.M., in the Council Chamber located in the Cit~ Hall of said city, there shall be a public hearing be- fore said City Council for t~e purpose of determining whether the publiC convenience and necessity require the. above described im- provement. ... - SECTION 5. That the City Clerk shall give notice of the hearing by posting a copy of this resolution in the manner pre- scribed by Section 5065 of the Streets and Highways Code and by publication as 'hereinafter provided. Any person interested may make protest against the proposed improvement in wri~ing filed with the City Clerk at any time not later than the hour set for the hearing 7" -2- 3056 in the manner provided by Section 5220 of the Streets and Highways Code. SECTION 6. That the City Clerk hereby is directed to publish this resolution in the "A'rcadia Tribune and' Arcadia News II on two successive dates, the first publication to be made not less than ten (10) days prior to the date of' the above public hearing. SECTION 7. That Resolution No. 3047 be and the same is +' hereby Tescinded. SECTION 8. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
