RESOLUTION NO. 3060
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA FINDING THAT THE PUBLIC CONVENIENCE AND
NECESSITY REQUIRE THE IMPROVEMENT OF FOURTH
AVENUE BETWEEN THE CENTER LINE OF NORMAN AVENUE
AND A POINT 200 FEET t SOUTH OF CAMINO REAL
AVENUE, ALL WITHIN THE CITY OF ARCADIA
WHEREAS, a public hearing has been held, duly and regularly
pursuant to Resolution No. 3056 and the laws and Constitution of
the State of California, on the proposed improvement of Fourth
Avenue between the center line of Norman Avenue and a point 200

feet t south of Camino,Real Avenue, all within the City of
Arcadia, by the installation and construction of sanitary sewers
and appurtenant work thereto; and
WHEREAS, said improvement has been considered fUlly;
NO\'I, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the said City Council hereby finds and
determines that the public convenience and necessity require the

improvement of:
Fourth Avenue between the center line of Norman Avenue
and a point 200 feet ~ south of Camino Real Avenue
within the City of Arcadia, by the installation and construction
of sanitary sewers and appurtenant work thereto. The nature, lo-
cation, and extent of the proposed improvement and the district
to be assessed for the cost and expense thereof are shown respec-

tively on the profile and improvement plan No. 238 and specifica-
tions entitled "Improvement of Fourth Avenue from Camino Real Ave-
nue to Norman Avenue for Installation of Sanitary Sewers" and
assessment district map No. W-71.
SECTION 2. That the said City Council hereby finds and
determines further that the "Special Assessment Investigation,
Limitation and Majority Protest Act of 1931" shall not apply to
the making of said improvement.

SECTION 3. That the said improvement shall be conducted
under the Improvement Act of 1911, which is Division 7 of the
Streets and Highways Code of the state of California, and the City
Engineer and the City Attorney hereby are instructed to present to
the said City Council the said Resolution of Intention required by
said Improvement Act to initiate the proceedings for the improve-
mente
SECTION 4. The City Clerk shall certify to the adoption

of this resolution, and thenceforth and thereafter the same shall
be in full force and effect.
