THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF AN ADDITIONAL DWELLING, AT 1208 SOUTH SIXTH AVENUE. THE CITi' COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. .That there was filed with the City Planning Commission on July 16, 1958, the application ofW. H. Seimerand ~ F. G. Seimer, as owners, for a zone variance to permit the erection of one additional dwelling with an attached garage on the front por- tion of the following described property in the City of Arcadia, County of Los Angeles, State of California, to wit: .' The south 92.5 feet of the north 185 feet of Lot 62, Tract No. 808, as shown on map re- corded in Book 16, pages 82 and 83, of Maps, Records of Los Angeles County, located at 1208 South Sixth Avenue. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and' 'before said Commission on August 12, 1958, at which t:lme all interested persons were given a 'full oppor- tunlty to be hea:rd and to present evidence. That upon the conclu- sion of said hearing, said Commission adopted its certain Resolu- tion No. 306, wherein and whereby it made certain findings and recommendations toth1s Council. SECTION? That there was only one written protest to the' granting of the variance, although there was a communication k signed by property owners in the vicinity opposing the granting of the variance until such time as the ch.ckens and non-conforming ., buildings are removed from the property. . , \ \ SECTION 3. That subject property was purchased by appli- cant at a time when it would have been permissible under R-l \ -1- 3071 .-/ , i regulations to add additional dwellings; that on August 21,1957, applicants applied to the Modification Committee of the Planning Commission for a rnodification of the applicable rear yard require- ments in order to construct two additional houses, with attached garages, to be located side by side at the front building line; that the Modification Committee on February 11, 1957, approved said applica~1on, and on appeal to the Planning Commission said decision was affirmed by the Planning Commission. That said deci- sion was then appealed to the City Council, and after a public hearing thereon on November 19, 1957, said application for modi- fication of the rear yard requirements was denied by the City Coun- cil; that on December 3, 1957, permission was given by the City Council to constI~ct one additional dwelling on subject property at the front building line in compliance with all applicable yard requirements; that said permission lapsed by reason of non-user on June 3, 1958. SECTION 4. That there, are ,many lots in the ,same vicinity, - as subject property already developed with more than one house ; that'. within 300 feet of said property, almost 50% of the lots have two or more dwellings thereon; that the granting of the variance is there- fore necessary for the pr~servation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. That the majority of the lots in the vicin- ity of subject property have a dwelling constructed at or near the front building line; that subject property is of sufficient size to permit an additional dwelling thereon with a reasonable distance between the dwellings upon the property. That the construction of an additional dwelling of no less size than the minimum prescribed for Zone R-l ami located at the front building line will be harmoni- ous to and in accord with the development of the area, will not be 1r -2- 3071 ~ detrimental to the public health or welfare, or injurious ,to the, property or improvements in the same zone or vicinity in which the property is local;ed and will not adversely affect the comprehensive general plan. That the circtunstances applicable to the property are now the same as ~lere applicable thereto at the time this City Coun- cil granted permission for one additional dwelling upon the property and the fact that the City Council after the adoption of Ordinance No. 990 granted a modification to permit an additional dwelling on subject property is an, exceptional circtunstance applicable to the property involved that does not apply generally to the property or k' class of use in the same zone or vicinity. SECTION 5. That for the foregoing reasons a variance is hereby granted to permit the construction of one additional dwell- ing at the front, building line upon condition that such additional dwelling shall comply with all other applicable requirements in- cluding required yards and size of dwelling. SECTION 6. The City Clerk shall certify to the, adoption of this ReSolution. ...
