A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DECLARING ITS INTENTION TO FORM A
LIGHTING MAINTENANCE DISTRICT, WHICH
DISTRICT IS TO PAY THE COST AND
EXPENSES FOR THE MAINTENANCE AND
OPERATION OF A STREET LIGHTING SYSTEM
ON PORTIONS OF MONTE PLACE, CANYON
ROAD, CIELO PLACE, LEE AVENUE, LA
RAMADA AVENUE, SECOND AVENUE, WINNIE
WAY, ANDREWS ROAD, HAVEN AVENUE,
NEWMAN AVENUE, LORENA AVENUE, EL
I~ONTE AVENUE, PALM DRIVE, HUNGATE
LANE, NINTH AVENUE, MAGNOLIA LANE,
EIGHTH AVENUE, SANDRA AVENUE, I~AGNA
VISTA AVENUE, THIRD AVENUE, LOUISE
AVENUE, PAMELA ROAD, SANTA ANITA
TERRACE, CAMINO REAL AVENUE, IVYLAND
AVENUE, BIRCHCROFT STREET, SOUTH VIEV.J
ROAD AND FAIRVIEW AVENUE IN SAID
CITY, AND FIXING A TIME AND PLACE FOR
HEARING OBJECTIONS TO THE FORMATION
OF SAID DISTRICT OR TO THE EXTENT
THEREOF.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY RESOLVE AS FOLLOWS:

SECTION 1. That the public interest and convenience re-
quire and it is the intention of the City Council of the City of
Arcadia to fo~n a lighting maintenance district to be known as
Lighting Maintenance District No. 13, for the purpose of assessing
said district to pay a portion of the cost and expenses of main-
taining and operating a street lighting system consisting of
seventy-fou~ (74) 2500 lumen lamps in said district on portions of
Monte Place, Canyon Road, Cielo Place, Lee Avenue, La Ramada Ave-
nue, Second Avenue, Winnie Way, AndreWS Road, Haven Avenue, Newman
Avenue, Lorena Avenue, El Monte Avenue, Palm Drive, Hungate Lane,
Ninth Avenue, Magnolia Lane, Eighth Avenue, Sandra Avenue, Magna
Vista Avenue, Third Avenue, Louise Avenue, Pamela Road, Santa
Anita Terrace, Camino Real Avenue, Ivyland Avenue, Birchcroft
Street, South View Road and Fairview Avenue.

SECTION 2. The items of expense of maintenance and op-
eration of the said lighting system to be furnished and to be
assessed in part against the lands within the district (exclusive
of improvements), are electric power, repairs, replacements,
maintenance, labor, materials, engineering, printing and advertis-
ing. The estimated amount of electric power necessaryllir said
system for each year is forty-five thousand eight hundred and two
(45,802) kilowatt hours and the estimated cost of said electric
power for the first year of maintenance and operation is the sum
of three thousand one hundred fifty dollars and forty cents
($3,150.40).

SECTION 3. That the said contemplated maintenance and
operation of said lighting system in the opinion of the City Coun-
cil of the City of Arcadia is of more than local or ordinary pub-
lic benefit and said City Council hereby makes the expense of said
maintenance and operation, exclusive of the amount to be paid by
said City as stated in Section 5 hereof, chargeable upon a dis-
trict, which district said City Council hereby declares to be the
district benefited by said maintenance and operation and to be
assessed to paIr the cost and expense thereof; which said district
shall, in general, include all of those lots fronting on said por-
tions of said streets.
A plat or map of said district, indicating by a boundary
line the extent of the lands included in the proposed district,
and indicating by symbol showing the type of lighting, was ap-
proved and adopted by the City Council of said City of Arcadia,
and is on file in the office of the City Clerk of the City of Ar-
cadia. Reference is hereby made to said plat or map for further,
full and complete description of said Lighting Maintenance Dis-
trict No. 13, and said map so on file shall govern for all details
as to the extemt of such district.

SECTION 4. . That said maintenance and operation shall be
furnished for said system for a period from the date of the forma-
tion of said district to and including January 31, 1962.
SECTION 5. The City Council of the City of Arcadia hereby
orders that fifty percent (50%) of the total maintenance and opera-
tion cost and expenses of said system be paid out of the treasury of
said City from the general fund of said City.

SECTION 6. Notice is hereby given that on Tuesday, the
20th day of January, 1959, at the hour of 8:00 o'clock p.m. of said
day, in the Council Chambers of said City Council of said City of Ar-
cadia, in the City Hall of said City, any and all persons owning land

or having any interest in lands within the district liable to be
assessed for the expenses of said maintenance and operation or any
portion thereof, may be heard and any of said persons may present any
objections that they may have by protest.
SECTION 7. All the proceedings for the aforesaid mainte~

nance and operation of said system shall be had and taken under and
in accordance with the provisions of an act of the Legislature of the
State of California, known and designated as the Municipal Lighting
Maintenance District Act of 1927, being Division 14, Part 3 of the
Streets and Highways Code of the State of California.
SECTION 8. The Superintendent of Streets shall post or
cause to be pOBted, copies of this Resolution headed "Notice of for-
mation of lighting maintenance district" along all open streets
within said district liable to be assessed, in the manner and form

required by law.
SECTION 9. The City Clerk shall certify to the adoption
of this Resolution and shall cause the same to be published twice,
to wit: on December 25, 1958 and on January 1, 1959, in the Arcadia

Tribune and Arcadia News, a newspaper of general circulation pub-
lished and circulated in the City of Arcadia and hereby designated
for that purpose"
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 16th day of December, 1958, by the affirmative vote of
at least three Councilmen, to wit:
