HomeMy WebLinkAbout3092 ~ RESOLUTION NO. 3092 A RESOLUTION OF THE CITY COUNCIL OF Till~ CITY OF ARCADIA, CALIFORNIA, Gfu\NTING A ZONE VARIANCE TO PERMIT Till!: CONSTRUCTION AND OPERATION OF, A TE11PLE AND RELIGIOUS SCHOOL AT THE COlmER OF FOOTHILL BOULEVARD AND SEGOND AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: ~ ~~vi.~ ~3/q\ >SECTION 1. That there was filed with the City Planning Commission on July 16, 1958, the application of the Foothill Jewish Community Center, as owner, signed by Charles Lapson, President, for a zone variance to permit the construction and operation of a temple and religious school upon ,the following The South 114.06 feet of the West 287.89 feet of Lot 20, F. A. Geier Tract, as shown on map recorded in Book 23, page 40, of Maps, Records of said County, described property ~ ~ .-v 1)-' ~'\.\? "" ;~,/! ~ '\\ .Y \?y in the County of los Angeles, State of California, to wit: , located at the northwest corner of Foothill Boulevard and Second Avenue. That after notice as required by Ordinance No. 760 of said City of Arcadia, as amended, a public hearing was duly held by and before said Commission on the 12th day of August, 1958, which said hearing was continued to August 26, 1958, which said hearing was again continued to September 10, 1958, which said hearing was again continued to Sept~nber 23, 1958 and still further continued to October 14, 1958; that at the October 14th hearing it was decided that inasmuch as the original application had been modified another ~ public hearing should be held on the matter. That after notice again as 'required by Ordinance No. 760, as amended, another public hearing was duly held on the matter by and before said Planning Com- mission on the 28th day of October, 1958, which said hearing was continued to November 12, 1958, at all of which times all interested t -1- 3092 I: f persons were given full opportunity to be heard and to present evi- dence. That upon the conclusion of said hearings, said Commission adopted its certain Resolution No. 318, wherein and whereby it made certain findings and recommendations to this Council. t SECTION 2. That there were protests, both oral and writ- ten, to the granting of the variance on the grounds that the noise and traffic thereby created would be detrimental to surrounding residential property and that there was other vacant property avail- able in the vicinity for such purpose; however, there were those, other than the proponents, who spoke in favor of granting the vari- ance under certain conditions. SECTION 3. That subject property is situated at the north- west corner of Foothill Boulevard and Secon~ Avenue; that the south- erly portion of the property facing on Foothill Boule~ard is zoned C-2 and the north'~rly portion facing on Sycamore Avenue is zoned R-l. That all of the property fronting on Foothill Boulevard in the - vicinity is zoned for commercial purposes. That applicant's prop- erty is the only property abutting the north side of Foothill within the block that extends northerly to Sycamore A~ti,; that all of the other properties abutting the north side of Foothill within the block are zoned for and usable for commercial purposes and parking incidental thereto, whereas only a portion of applicant's property may be used for c(lmmercial purposes and the parking incidental thereto and the balance is restricted to single family residential purposes, although all of applicant's property comprises but one lot or parcel of land. That the variance as hereinafter granted is therefore rea- sonably necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. That the intended use of applicant's prop- erty for a temple and religious school which is a use permissible ~ in zone R-2 is an exceptional circumstance applicable to the intended -2- 3092 t' use thereof that does not apply generally to the use or class of use in the same zone or vicinity. That the granting of the vari- ance as hereinafter provided will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located; that the granting of such variance will not adversely affect the comprehensive general plan. That the public welfare and convenience reasonably require the granting of the variance, and upon the conditions hereinafter set forth, said variance will not be inconsistent with good planning practice, nor with the present or prospective development of the neighborhood, in whi9h the property is located. . ~ SECTION 4. That for the foregoing reasons, a variance is hereby granted to permit the construction and operation of a temple and religious school on the above described property upon ,the following conditions: a. That the south 252 feet of the property be used for the temple and religious school purposes. b. That the north 158 feet of the south 410 feet of the property be used for automobile parking purposes. c. That the north 175 feet of the property remain in Zone R-l. d. That a block wall six feet high be constructed along the west line of the property from a point 175 feet south of Sycamore Avenue to a point 375 feet south of Sycamore Avenue, said wall to be conn.ected to the school building wall; and along the north line of the parking lot, reducing the height to four feet at the building line of Second Avenue. e. ~~hat a five-foot wide planting area, with adequate provision for watering, be constructed and maintained to screen the parking 101; from Second Avenue. +.. -3- 3092 + f. That the north five fe,et of the property, with a 20- foot corner radius at Second Avenue, ,be dedicated for the widening of Sycamore Avenue; and a 20-foot corner radius be dedicated at Foothill Boulevard and Second Avenue. g. That curbs and gutters be constructed along the Second Avenue and Sycamore Avenue frontages of the property. h. That the owners sign a covenant agreeing to dedicate for alley purpos.es the west 10 feet of the property to a depth of 210 feet north of Foothill Boulevard, if an alley becomes necessary r- at the rear of the C-2 property to the west, provided the owners of the C-2 lots west of subject property dedicate the easterly ten feet to a depth of 210 feet of those lots for the entrance alley and dedicate an alley westerly thereof to the wash at the rear of the commercial frontage, such offer of dedication to terminate if the full dedication and opening of the alley is not accomplished within a ten-yea,r period. i. That any play area needed shall be located within - the inner court of the building. j. That all parking lot lights shall be indirect, hooded and directed aw~~ from residential property. k. That final plot and building plans shall be approved by the Planning Commission before issuance of a building permit. 1. That the portion of the building within the C-2 Zone and No.1 Fire Zone shall be relieved of the construction require- ments of No. 1 Fire Zone. SECTION 5. . The City Clerk shall certify to the adoption of this Resolution.
