RESOLUTION NO. 3097
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE TO PERMIT
TIiE CONSTRUCTION AND OPERATION OF A
CONVALESCENT HOME AT 452-464 WEST
HUNTINGTON BOULEVARD.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOWS:

SECTION 1. That there was filed with the City Planning
t Commission on October 14, 1958 the application of Tony Panzich, as
owner, for a zone variance and/or special use permit to permit the
construction and operation of a 48-bed convalescent home upon the

following described property in the County of Los Angeles, State
of California, to wit:
Lots 23 and 24, Tract No. 2828, as shown on
map recorded in Book 33, page 63, of Maps,
records of said County,
located at 452-464 West Huntington Boulevard. That after notice as
J:'equired by Ordinance No. 760 of the City of Arcadia, as amended,
a public hearing was duly held by and before said Commission on
October 28, 1958, which said hearing was duly continued to
November 12, 1958, at each of which times all interested persons
were given a full opportunity to be heard and to present evidence.
That upon the conclusion of said hearing, said Commission adopted
its certain Resolution No. 319, wherein and whereby it made certain
findings and reco,nmendations to this Council.
SECTION 2. That there were both written and oral pro-
tests to the granting of the variance although there was one com-
rnunication and several who spoke in favor of granting the variance
under certain conditions.
SECTION 3. That the use of subject property for a con-
valescent home is somewhat related to and would not be incompatible

~lith the uses allowed in Zone C-O, in which the property is lo-
cated; that there is need for such an institution in this area;
and that the foregoing constitute exceptional conditions appli-
cable to the intended use of the property that do not apply gen-
erally to properties or classes of use in the same zone or vicin-
ity. That the construction of the building, as planned, would
resemble a private residence in appearance and would not devaluate
property in the neighborhood; that under the type of state license
proposed to be obtained by applicant, the care of mental cases or

alcoholics would be prohibited by the state Board of Health regu-
lations; and the granting of a variance upon certain conditions
would not be materially detrimental to the public health or wel-
fare nor injurious to the property or improvements in the zone or
vicinity in which the property is located. That the variance re-
quested is necessary for the preservation and enjoyment of a sub-
stantial propert;y right of the applicant possessed by other prop-

erty in the same zone or vicinity in that variances have been
granted for professional uses in the same general vicinity; and
the variance under certain conditions w~~l not adversely affect

the comprehensive general plan.
SECTION 4. That for the foregoing reasons a variance
is hereby granted to permit the construction and operation of a
convalescent home at 452-464 West Huntington Boulevard upon the
following conditions:
a. That the entire project be moved forward on the lot
so as to clear the required rear yard and that a revised plot plan
be submitted.
b. That the rear 30 feet be landscaped and maintained
as a landscaped area.
c. That final plans, conforming substantially with the
tentative plans including landscaping, revised as herein required,
'" be submitted to the Planning Commission for approval prior to the
issuance of a building permit.

d. That parking area lights be indirect, hooded and di-
rected away from residences in the area.
e. That the use of the building be so restricted that
no mental patients, alcoholics or contagious disease cases be ad-
mitted or kept.
f. That a six-foot concrete block wall be erected on
the rear lot line and along the sides of the parking lot.
g. That the applicants record an irrevocable offer of
dedication for an easement for alley purposes across the rear 30

feet of the abov,= described property and tender a duly executed
deed therefor for acceptance by the City at a future date.
,h. That each of the foregoing conditions shall continue
throughout the duration or use of the variance hereby recommended
to be granted, and the violation of anyone or more of said condi-
tions shall constitute grounds for the revocation, cancellation
Or modification of the variance hereby recommended.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.

I HEREE~ CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 6th
