HomeMy WebLinkAbout2914 '. ~ - RESOLUTION NO. 2914 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DETERiUNING THAT THE PUBLIC ~1ELFARE, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR A PUBLIC PURPOSE, TO WIT, THE CONSTRUCTION OF A NEW CENTRAL FIRE STATION. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES J-l.EREBY RESOLVE AS FOLLOWS: SECTION 1. That tne City Council finds, determines and declares tnat tne publiC welfare, convenience, interest and neces- sity require the acquisition of the real property hereinafter de- scribed for the purpose of constructing a new Central Fire Station upon said property. That the City of Arcadia is a municipal cor- poration, to wi~, a charter city in the County of Los Angeles, State of California. That the purpose for which it is proposed to acquire the property hereinafter described ~~ a public purpose; that the ~ acquisition of Baid property and the construction of a Central Fire Station thereon is a public improvement; and that such public im- provement has been plaIVled and located in a manner that is compatible with the greate~lt public good and the least private injury; that the acquisition of the property hereinafter described for the purposes hereinbefore set forth is authorized by law. SECTION 2. That the City Council of the City of Arcadia hereby finds, determines and declares that "the publiC interest and necessity require, for the purpose hereinbefore set forth, the acqui- sition by the City of Arcadia, in its name, of the real property and the interests in the real property hereinafter described and the City Council hereby declares that it is the intention of the City of Ar- cadia to acquire in its name, by condemnation in accopdance with the provisions of the Code of Civil Procedure and of the Constitution -1- 2914 -- -----....- ~.~ - of the State of' C2lifornia authorizing the exercise of the right of eminent domain by a city, the real property and the interests in the real property hereinafter described for the purposes hereinbefore set forth. SECTION 3. That the City Attorney of the City of Arcadia be and he is hereby authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Arcadia, such pro- ceedings in the proper court having jurisdiction thereof, as are neces- sary for such acquisitionj and for such punpose he is authorized to employ such legal counsel and assistance, including qualified apprais- ers, as he deems necessary and to take any and all necessary or proper action, including the opening of escrows for the acquisition of said property. SECTION 4. That the real property or interests in real property which the City of Arcadia proposes to acquire and by this resolution declares necessary to acquire for the purposes hereinbe- fore set forth and for the acquisition of which the City Attorney of the City of Arcadia is by this resolution authorized, empowered and directed to prepare, institute and prosecute proceedings, is the fee title in and to the ;r:eal property particularly descr;l.becl as follows: Lots ~) and 6, Block 1, Tract No. 101, as re- corded in Book 13, page 52, of Maps, records of Lo:'l Angeles COUJ:1ty. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
