HomeMy WebLinkAbout2925 RESOLUTION NO. 2925 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CLASSIFYING THE BUSINESS OF A VETERINARY CLINIC AS A USE PERMISSIBLE IN ZONE M-I UNDER ORDINANCE NO. 760 OF THE CITY OF ARCADIA. WHEREAS, the business of a veterinary clinic is nowhere specifically listed as a use permiSSible in any zone under Ordinance No. 760 of the City of Arcadia; and, WHEREAS, there has been requested a classification of such a business under Ordinance No. 760 of the City of Arcadia; and, WHEREAS, ambiguity has arisen concerning the appropriate classification of such use within the meaning and intent of Ordinance No, 760 of the City of Arcadia; anq., WHEREAS, Section 15-A-l of said Ordinance No. 760 provides in part "...if ambiguity arises concerning the appropriate classification of a particular use within the meaning and intent of this Ordinance..."; and, WHEREAS at a regular meeting of the City Planning Commission, said Commission ascertained t~1e pertinent facts concerning the busi- ness of a veterinary clinic for which classification had been requested, and thereupon made its determinations and recommendations under its certain Resolution No. 262, adopted August 27, 1957; and, , WHEREAS, the City Council has reviewed said recommendations and fully considered the matter; NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY DETERMINE AND FffiSOLVE AS FOLLOWS: SECTION 1. 'I'hat the business of a veterinary hospital is specifically cla:3sified as a use permissible in Zone M-l under Section 11 of Ordinance No. 760; that there is no substantial difference between the business of a veterinary clinic and a veterinary hospital sufficient -l- 2925 to warrant the classification of the business of,veterinary clinic any differently than the business of a veterinary hospital; that both businesses involve the treatment and care of animals upon the premises upon which the business is conducted and the transportation of animals thereto and therefrom; and the fact that the conduct of a veterinary clinic as proposed would not entail the keeping of animals on the premises over-night is not sufficient to warrant a separate classi- fication for the business of a veterinary clinic, SECTION 2, That for the foregoing reasons the business of a veterinary clinic should be deemed to be and is hereby determined to be and is specifically classified as a use permissible in Zone M-l under Section 11 of Ordinance No. 760. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 17th day of September , 1957, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Jacobi, Reibold and Dennis NOES: None ABSEN',r: Councilmen Camphouse and Phillips ~o~~ SIGNED AND APPROVED this 17th , 1957.
