HomeMy WebLinkAbout2947 RESOLUTION NO. 2947 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR A VARIANCE TO PERMIT THE OPERATION OF A VETERINARY CLINIC AT 727 WEST DUARTE ROAD. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION I, That there was filed with the City Planning Commission on August 27, 1957, the application of Arcadia Parking, Inc" as owner, signed by James L. Murray as Vice President and Fern L. Griffin as Secretary, for a zone variance to permit the fol- lowing described property in the City of Arcadia, County of Los An- geles, State of California, to wit: A portion of Lot 124, Tract No. 2731, as shown on map recorded in Book 33, page 29, of Maps, records of said County, located at 727 West Duarte Road, to be used for the purpose of a veterinary clinic office; and that after notice as required by Ordi- nance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said Commission on the lOth day of Sep- tember, 1957, which hearing was duly continued to October 8, 1957, at which times all interested persons were given a full opportunity to be heard and to present evidence, SECTION 2, That there were many protests, both oral and written to the granting of the requested variance, That the use of property for a, pet clinic has been previously determined by the City Council as a use properly conducted in an M-I Zone; and the intended use as proposed and without adequate restrictions would create loud noises and offensive smells and would therefore be injurious to the property and j.mprovements in the vicinity in which the property is located. -l- 2947 SECTION 3. That it was not shown that there are excep- tional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same zone or vicinity. Nor was it shown that the variance is necessary for the preservation or enjoyment of a substantial property right of the applicant possessed by other property in the same zone or vicinity, . SECTION 4. That subject property is in an area near the intersection of two major thoroughfares and all the property abut- ting such thoroughfares in the immediate vicinity, including sub- ject property, is zoned C-2, That other properties thus c~assified C-2 in this vicinity have been well developed to and consistently used for permissible C-2 purposes. That subject property abuts prop- erty to the north zoned for, developed to, and used for multiple f'amily purposes, and the requested use of subject property is not compatible with the development and use of such adjacent properties, SECTION 5, That f'or the foregoing reasons, the applica- tion of Arcadia Parking, Inc" for a variance to permit the opera- tion of a veterlnary clinic at 727 West Duarte Road be, and the same is hereby denied. SECTION 6. The City Clerk shall certUY to the adoption of this Resolution.
