RESOLUTION NO. 2958
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA SETTING A HEARING FOR THE PURPOSE
OF DETERMINING WHETHER OR NOT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE IMPROVE-
MENT OF LOUISE AND LeROY AVENUES, ALL WITHIN
THE CITY OF ARCADIA.
WHEHEAS, Section 17 of Article XIII of the Constitution
of the State of California provides that the debt limitation and
majority protest provisions of said section shall not apply if,
after the giving of such reasonable notic~ by publication and
posting and the holding of such public hearing as the City Council
of the City of Arcadia shall have prescribed, said council by
no less than a 4/5ths vote of all members thereof, finds and
determines that the publiC convenience and necessity require the
improvement proposed to be made; and
WHElmAS, Section 2804 of the Streets and Highways Code
of the State of California provides that, the "Special Assessment
Investigation, Limitation and Majority Protest Act of 1931" shall
not apply to any proceeding otherwise subject thereto when said
irnprovement proceeding is by a charter city and said city has
complied with the provisions of Section 17 of Article XIII of the
Constitution of the State of California; and
WHElliAS, the City of Arcadia is a charter city of the
State of California.
NOW, THEREFORE, The City Council of the City of
Arcadia does resolve as follows:
SECTION 1. That said City Council proposes to
initiate proceedings for the improvement of Louise Avenue and
LeRoy Avenue, all within the City of Arcadia, by the clearing
of the right of way, installation and construction of cast iron
water line, installation and construction of sanitary system,
grading, preparing subgrade, paving with asphaltic plant mix

pavement, and construction of Portland cement concrete curbs
and gutters, and appurtenant work thereto. The nature, location,
and extent of the proposed irnprovement and the district to be
assessed for the cost and expenses thereof are as shown
respectively on the plan and profile No. D-2ll adopted by the
City Council of the City of Arcadia, by Resolution No. 2956
on Decernber 17, 1957, and assessment district map No. w-69,
adopted by the said City Council by Resolution No.2957 on
December 17, 1957, and in accordance with specification entitled
"Specifications and Contract Documents for Street and Water
Improvements for Louise and LeRoy Avenues in the City of
Arcadia", which said specification duly was adopted by said
City Council by Resolution No.2956 on the 17th day of December,
1957, which said plan and profile, assessment district map and
specification now are on file in the offices of the City
Engineer and of the City Clerk of said City, to which said plan
and profile, assessment district map and specification reference
is rnade for all particulars relative thereto.
SEC~~ION 2. That the total estimated cost of the
proposed improvernent is $36,587.00.
SECTION 3. That the said irnprovernent shall be con-
ducted under the Improvement Act of 1911, which is Division 7
of the Streets and Highways Code of the State of California.
SECTION 4. That notice hereby is given that on the
7th day of January, 1958, at 8:00 P.M., in the Council
Chambers located in the City Hall of said city, there shall be
a public hearing before said City Council for the purpose of
determining whether the public convenience and necessity require
the above de:3cribed improvernent.
SEC'rION 5. That the City Clerk shall give notice of
the hearing by posting a copy of this resolution in the rnanner

prescribed by Section 5065 of the Streets and Highways Code and
by publication as hereinafter provided. Any person interested
may make protest against the proposed irnprovement in writing
filed with the City Clerk at any time not later than the hour
set for the hearing in the rnanner provided by Section 5220 of
the Streets and Highways Code.
SEC~~ION 6. That the City Clerk hereby is directed to
publish this resolution in the Arcadia Tribune and Arcadia News
on two succesE:ive dates, the first publication to be made not
less than ten (10) days prior to the date of the above public

SEC~~ION 7. The City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
