"'" RESOLUTION NO. 2964 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FINDING THAT THE PUBLIC CONVENmNCE AND NECESSITY REQUIRE THE IMPROVEMENT OF LOUISE AVENUE AND LeROY AVENUE, ALL WITHIN THE CITY OF ARCADIA. WHEREAS, a public hearing has been held duly and regularly, pursuant to Resolution No. 2958 and the laws and Constitution of the State of California, on the proposed improve- rnent of Louise Avenue and LeRoy Avenue, all within the City of Arcadia, by the clearing of the right of way, installation and construction of cast iron water line, installation and construction of sanitary systern, grading, preparing subgrade, paving with asphaltic plant mix pavernent, and construction of Portland cernent concrete curbs and gutters, and appurtenant work thereto; and WHEREAS, said improvement has been considered fully: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the said City Council hereby finds and determines that the pUblic convenience and necessity require the irnprovernent of Louise Avenue and LeRoy Avenue, all within the City of Arcadia, by the clearing of the right of way, installation and construction of cast iron water line, installation and construction of sanitary system, grading, preparing subgrade, paving with aBphaltic plant mix pavement, and construction of Portland cement concrete curbs and gutters, and appurtenant work thereto, the nature, location and extent of the proposed irnprovement and the district to be assessed for the cost and expense thereof are shown respectively on the profile and improvement plan No. D-211, and specifications entitled "Specifications and Contract Documents for Street and Water Irnprovernents for Louise and LeRoy Avenues in the City of Arcadia" :P 9 I' r,r and assessrnent district rnap No. w-69. SEC'rION 2. That the said City Council hereby finds and deterrnines further that the "Special Assessrnent Investiga- tion, Limitation and Majority Protest Act of 1931': shall not apply to the rnaking of said improvernent. SEc'rION 3. That the said irnprovernent shall be con- ducted under the Irnprovement Act of 1911 which is Division 7 of the streets and Highways Code of the state of California, and the City Engineer and the City Attorney hereby are instructed to present to the said City Council the said Resolution of Intention required by said Improvement Act to initiate the proceedings for the irnprovement. SECTION 4. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
