HomeMy WebLinkAbout2967 RESOLUTION NO. 2967 A RESOLUTION OF THE CITY COUNCIL OF ~rHE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR A VARIANCE ~ro PERMIT THE CONSTRUCTION AND lllAINTENANCE OF A PET HOSPITAL AT 108 lVEST LAS TUNAS DRIVE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on August 26, 1957, the application of Reuben V. Senior and Fanny L. Senior, as owners, for a zone variance to perrnit the following descrlbed property in the City of Arcadia, County of Los Angeles, State of California, to wit: The West 75 feet of the East 135 feet, exclusive of streets, of Lot 68, Santa Anita Colony, as shown on rnap recorded in Book 42, page 87, Mis- cella~eous Records of said County, located at 108 Nest Las Tunas Drive, to be used for the construc- tion and rnaintenance of a pet hospital; and that after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing; was duly held by and before said Commission on the 10th day of Septernber, 1957, which hearing was duly continued to October 8, 1957, at which tirnes all interested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of the hearing on said matter, the City Planning Commis- sion adopted its certain Resolution No. 267, wherein and whereby it made certain findings and recommended that the application for a variance to perrnit the construction and maintenance of a pet hos- pital upon the above described property be granted upon certain con- ditions therein specified. SECTION 2. That within ten days after the adoption of aforesaid Resolution No. 267, a written appeal therefrorn to the City Council was filed with the City Clerk by persons aggrieved thereby, -1- 2967 pursuant to which appeal the City Council did, on November 5, 1957, fix November 19, 1957, at the hour of 8:00 o'clock p.rn., in the Council Ch~nbers in the Arcadia City Hall, as the tirne and place for a public hearing to consider the aforesaid recommendation of the City Planning Commission and the said appeal therefrorn. That at said public hearing, duly held on Novernber 19, 1957, by and before this City Council, after notice, all persons interested in the matter were given full opportunity to be heard. SECTION 3. That there were numerous protests, both oral and written, to the granting of the variance, largely upon the grounds that it would in effect constitute spot zoning and would de- preciate properties in the area, particularly residential properties. SECTION 4. That the granting of the variance is not neces- sary for the preservation of any substantial property right of the applicant inasrnuch as subject property is presently zoned C-2 and recent developments in the area clearly indicate that prpperty in the area is highly deSirable and readily usable for C-2 purposes; that proposed developrnent of vacant areas in the vicinity have reduced, if not rernoved, both the need and the desirability of further vari- ances affecting property within the so-called "Triangle". That it has not been shown that the granting of the variance, either as re- quested or as recommended, will not adversely affect the cornprehen- sive general plan. That it has not been satisfactorily shown that the granting of the variance, either as requested or as recommended, will not be rnaterial1y injurious to property or irnprovernents in the zone or vicinity in which the subject property is located. SECTION 5. That for the foregoing reasons, the City Coun- cil sustains the appeal heretofore filed with the City Clerk, disap- proves the findings and recommendations of the City Planning Commission conta.ined in aforesaid Resolution No. 267 insofar as -2- 2967 they support and recommend the granting of a variance; and a vari- ance to perrnit the construction and rnaintenance of a pet hospital upon the above described property, both as requested and as recorn- rnended by the City Planning Commission, is hereby denied. SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
