HomeMy WebLinkAbout2968 RESOLUTION NO. 2968 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, SETTING A PUBLIC HEARING CONCERNING AND GIVING NOTICE OF THE TIME AND PLACE OF A PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CITY LIMITS OF THE CITY OF ARCADIA, THE SAME BEING SITUATED NEAR THE SOUTHEAST PORTION OF THE CITY OF ARCADIA AND DESIGNATED AS "SOUTHEAST ARCADIA UNlliHABITED ANNEXATION NO. 18." THE 8ITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOvlS: SECTION 1. That on January 3, 1958, there was filed with the City Clerk of the City of Arcadia a valid and sufficient petition for the annexation to the City of Arcadia, pursuant to the "Annexation of Uninhabited Territory Act of 1939," of the territory and property therein and hereinafter in Section 2 described. That said petition '~as signed by the owners of all of the land in the ter- ritory by area, and by assessed value of such territory as shown on the last equalized assessment roll of the County of Los Angeles, re- questing that the territory therein and hereinafter described be annexed to the City of Arcadia. That the said territory and property is uninhabited and is contiguous to the City of Arcadia and is not a part of any other municipal corporation. That said proposal for the annexation of said territory to the City of Arcadia has been sub- mitted to and reported upon to the proponents by the Boundary Commis- sion of the County of Los Angeles with respect to the definiteness and certainty of the proposed boundaries, pursuant to Section 35002 of the Government Code of the State of California; and rnay be an- nexed to the City of Arcadia pursuant to the aforesaid "Annexation of Uninhabited '1.'erritory Act of 1939." -1- ,::f( ," . That pursuant to the provisions of the "An_ nexation of Unlnhabited Territory Act of 1939" the City Council of the City of Arc:adia fixes and establishes and hereby gives notice that February 10, 1958 , at the hour of 8:00 o'clock p.m. in the Council Chc~bers of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California, a public hearing shall be held by and before the Cit~7 Council of the City of Arcadia to consider and hear protests concerning the annexation to said City of the property hereinafter deacribed and that any person owning real property within such territory so proposed to be annexed and having any ob- jection to the proposed annexation may appear before the City Coun- cil of the City of Arcadia and show cause why such territory should not be so annexed. Any protests must be in writing, may be filed at any tirne before the hour set for hearing objections to the pro- posed annexation and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. That said territory shall be and the same is hereby designated as "Southeast Arcadia Uninhabited Annexation No. 18." That a specific description of the boundaries of said ter- ritory so proposed to be annexed is as follows: That portion of Lot 126, Arcadia Acreage Tract, in the County of Los Angeles, state of Cali- fornia, as recorded in Book 10, page 18, of Maps.. records of said county, described as fol- lows: Beginning at the southeast corner of Tract No. 21122 as recorded in Book 568, pages 44 and 45, of Maps, records of said county; thence southerly alonl~ the westerly line of the easement for flood cont~ol ~urposes as provided in deed recorded in Book 17446, page 163, of Official Records of said Coun';y, South 11045'53" v/est 177.29 feet to the begilming of a tangent. curve concave to the East and having a radius of 2070.00 feet, said curve also being said westerly line; thence southerly alo~s said curve to a northerly line of the City of Arcadia; thence westerly, northeasterly and eastl~rly along the boundary lines of the City of Arcadia, as the same existed on Decernber 1, 1957, to the point of beginning. -2- /,96 SECTION 3. The City Clerk of the City of Arcadia shall certify to the adoption of this Resolution and shall cause a copy of this Resolution to be published at least twice, but not oftener than once a we'3k, in the Arcadia Tribune and Arcadia News, a news- paper of general circulation published in the City of Arcadia, said publication to be completed at least twenty days prior to the first public hearing on such proposed annexation; and the City Clerk shall also cause written notice of such proposed annexation to be mailed not less than twenty days before the first public hearing on such proposed annexation, to each person to whom land within the terri- tory proposed to be annexed is assessed in the last equalized county assessrnent roll available on the date the proceedings were initiated, at the address shown on said assessrnent roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable, with said City Cler~, all as provided in Section 35311 of the Governrnent Code of the State of California. I HEFEBY CERTIFY that the foregoing Resolution was adopted at a regular rneeting of the City Council of the City of Arcadia held on the 7th day of January , 1958, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilrnen Camphause, Jacobi, Phillips, Reibold and Dennis NOES: None ABSENT: None (~~~4t:~ , 1958.
