RESOLUTION NO. 2985
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
GRANTING A ZONE VARIANCE TO PERMIT
THE CONSTRUCTION AND MAINTENANCE OF
APARTMENTS OVER A PROPOSED MORTUARY
AT 611 ~IEST DUARTE ROAD.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE
{',NO RESOLVE AS FOLLOHS:
SECTION 1.
That there was filed with the City Planning Commission on the
23rd day of December, 1957, the appl ication of Johanna M. Wenz, as owner, for a zone
variance to permit the construction and maintenance of apartments over a proposed
mortuary for which a variance and special use permit w~re granted by Resolution No.
2887 adopted by this Council on May 21, 1957, which proposed mortuary is to be
loc<lted at 611 I/"s t Duarte Road on property in the City of Arcad i a, County of Los
Angcles, State of Cal ifornia, described as Lot 44, Tract No. 3430, as shown on map
recorded in Book 42, page J2, of Maps, records of Los Angeles County. That after
notic~ as required by Ordinance No. 760 of the City of Arcadia, as emended, a public
h~aring was duly h~ld by and before said Commission on January 14, 1958, which said
hearing was duly continued to January 28, 1958, at each of which times all interested
p~rsons were given a full opportunity to be heard and to present evidence. That upon
the conclusion of said hearings, said Commission adopted its c~rtain Resolution No.
275, wh~rein and whereby it made certain findings and recommendations to this Council.
jECTION 2.
Th~t there were ~rotests to the granting of the variance; that
said protests, howeve~, w~re against the construction and operation of th~ mortuary
its~lf <It said location, for which a variance and special use permit already have
been granted by aforesaid Resolution No. 2887, rather than against the construction
of apartments above the mortuary. That the construction of 1 iving quarters is esscn-
tial to the conduct of the mortuary business; that although the proposcd addition
results in a two-story portion of the building, the exterior elevation is substantially
in compl iance with the original plan submitted and approved by the aforesaid Resolution

No. 2887; that the rermdel ing of the original dwelling to conform to the architec-
tural design of the new building to b~ er~cted will comply with the intent of the
variance )raroted by RE~solution No. 2887.
SECTION 3. That the need of living quarters in connection with a m9rtuary
constitut~s an exceptional circumstance appl icable to the int~nded use of subject
property that does not apply generally to property in the same vicinity. That the
gr~nting of the variance under the conditions hereinafter specified will not be
detrimental to the pub I ic health or welf~re or injurious to the property or improve-
mcnts in the zone or vicinity in which subject property is located; that it will not
be inconsistent with good planning practice or the provisions of the master zoning
pl~n. nor will it adversely affect the comprehensive general plan. That the requested
variance is reasonably necessary for the preservation and enjoyment of a substantial
property right of the appl icant.
SECTION 4. That for the foregoing reasons, a v~riance is hereby granted
to permit the constru<:tion and occupation of apartments over the proposed mOrtuary
upon the property described in Section I hereinabove, upon the following conditions:
a. That plans for rerr.ode 1 i ng the ex 1st i ng dwe 11 i ng be submi tted
for approval by the Planning Commission before final inspection is given on the
mortuary building;
b. n:at the apartments constructed pursuant to the variance hereby
granted shall be used solely in connection with the mortuary business for the use
of the owner or em~loyees of the mor~uary business and shall not be used by or rented
to any other persons.
c. That the remodel ing of the existing dwell ing in accordance with
the plans thus approved be completed within six (6) months after completion of the
mortuary construction;
d. That the special use permit for the construction, maintenance
and operation of a mortuary as heretofore granted by aforesaid Resolution No. 2887
be amended to the extent required by the provisions hereof.
SECT! ON 5.
The City Clerk shall certify to the adoption of this resolution.
