HomeMy WebLinkAbout2986 RESOLUTION NO. 2986 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT THE ERECTION OF A SIGN AT 600 tfEST LAS TUNAS DRIVE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Com- mission on the 18th day of November, 1958, the application of Carl Sugar, as Lessee, for a zone variance to permit the erection of a neon roof sign, eight feet by fourteen feet, on property in the City of Arcadia, County of Los Angeles, State of California, described as Lot 25, Tract No. 6641, per map recorded in Book 126, page 67, of r~aps, records of Los Angeles County, located at 600 West Las Tunas Drive. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said COlnmission on December 10, 1957, which said hearing was duly continued to January 14, 1958, at each of which times all inter- ested persons were given a full opportunity to be heard and to pre- sent evidence. That upon the conclusion of said hearings, said Com- mission adopted its certain Resolution No. 273, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That thereupon the City Council did, upon its own motion, se'~ the matter for public hearing on February 18, 1958. That on February 18, 1958, after due notice, a public hearing was held by and before this Council, which hearing was duly and regu- larly continued to February 2l, 1958, at each of which times all interested persons were given full opportunity to be heard and to present evidence. -l- 2986 SECTION 3. That at the hearings before the City Planning Commission and the City Council, three protests were made to the granting of the requested variance, two of which protestants pro- fessed to lack knowledge that the property had even been zoned so as to permit a restaurant; one protestant on property to the rear objected on the grounds that the proposed sign might shine on his property. SECTION 4. That the variance for a post sign to be erected upon the property immediately west of the above described property has already been recommended by the Planning Commission and granted by the City Council. That the granting of a variance to permit the erection and operation of a sign of the size and type and upon the conditions hereinafter recommended will not be materi- ally deterime~tal to the public health or welfare or injurious to the property or improvements in the zone or vicinity in which the subject property is located. SEC'l~ION 5. Tha t the Zoning Ordinanc e permits the c onduc t of a restaurant upon the subject property and such a restaurant has been constructed and is being operated thereon; that it will not be inconsistent ~r1th good planning practice or with the provisions of the master zoning plan, nor will it adversely affect the comprehen- sive general plan to permit a relatively small informational si~n upon the commercial establishment erected upon the subject property; that the requested variance is reasonably necessary for the preser- vat ion and en,;oyment of a substantial property right of the appli- cant. for SECTION 6. That/the foregoing reasons, a variance is hereby granted to permit the erection and operation of an identi- fication sign upon the following terms and conditions: a. That such sign shall not exceed eight (8) feet in height nor fourteen (14) feet in width; -2- 2986 b. That the bottom of such sign shall be no more than four (4) feet above the roof line of the restaurant build- ing presently located upon the above described property; . ~ . That the sign shall be of recessed lighting, and shall be located at right angles to the adjacent street; d. That the sign hereby permitted shall not be a flashing s:ign but shall be continuously lighted while in use; e. That such sign shall not be illuminated except while the :~estaurant business it advertises is open for busi- ness and in no event shall such sign remain lighted between the hou:cs of l:~ :01 a.m. and 6 :00 a.m. of any day. f. That such sign shall advertise only the restaurant business conducted upon the premises and shall in all other re- spects con~orm with all applicable city ordinances; g. That such sign shall in all other respects conform with the design heretofore submitted with the application and hereby approved. SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
